كان إفتاء الناس عند كبار الصحابة مألوفاً لا سيما في الحوادث والنوازل التي ليس فيها نص من كتاب أو سنة. وكان هؤلاء الكبار من الصحابة - رضي الله عنهم - على ثلاثة مراتب: منهم المكثرون في الفتوى، ومنهم المتوسطون، ومنهم المقلون.
وهذه الرسالة دراسة فقهية مقارنة لبعض فتاوى المقلين في الفتوى من كبار الصحابة؛ للوقوف على مأخذ الحكم لديهم، ومدى مطابقة هذه الفتاوى لفتاوى المكثرين منهم، وأثر تلك الفتاوى في تأسيس المذاهب الفقهية المعتمدة بعد ذلك، والاستفادة من هذه الفتاوى في بعض المسائل المعاصرة لبيان الحكم الشرعي فيها بما يتناسب مع الزمان والمكان
The practice of seeking fatwas (religious rulings) from the senior companions of the Prophet (peace be upon him) was common, especially in situations where there was no explicit text from the Quran or Sunnah. These senior companions can be categorized into three groups: those who frequently issued fatwas, those who moderately issued fatwas, and those who rarely issued fatwas.
This study is a comparative fiqh (Islamic jurisprudence) analysis of some fatwas issued by the companions in the third category, aiming to understand their sources of judgment, the extent to which these fatwas align with the rulings of the more frequent issuers among them, and the influence of these fatwas in establishing the later adopted schools of fiqh. Additionally, this study seeks to derive insights from these fatwas to address contemporary issues and determine their corresponding Islamic rulings in accordance with the time and place.
