| Summary, etc. | All the praises and thanks be to Allah, the Lord of the 'Alamin (mankind, jinns and all that exists) and blessing and peace be upon his faithful prophet, his family, his companions and followers who followed them exactly (in faith), to begin,<br/>The most important thing that rectifies the path of the charitable institutions and increases their endeavor and activity and safeguards them from deviations and lapse is their abidance by the provisions of the Islamic law and this abidance cannot be conceived except by the obedience of the ruler in authority and whatever this obedience dictates of laws and instructions where this was referred to by the Islamic Law as both principles lead to achieving the abidance by religion and hence the worldly life and the Hereafter are straightened up which is the aim of the Law- giver, glory be to him. Thus, it became indispensable to link and compare between the Islamic Shariah and the law in interpreting the provisions of the charitable institutions and explaining the areas of agreement and disagreement between the Shariah and the law so that the charitable institutions follow a valid approach that is in agreement with the Islamic Shariah and the law that prevents and preserves it from violations and failures and this can yield plenty of activities and humanitarian, educational and advocacy projects that have an impact reflected on the local and international community. This is the main objective of writing this research as I discussed key issues of the institutional charity work stating in details its provisions in the Islamic Shariah and law as I discuss the Egyptian and Kuwaiti Law for non-governmental work, and among these key issues: Explaining the legal characterization of those who are acting as responsible persons for these charitable institutions and the legal opinion regarding them, also the resources and the banks of these charitable institutions in the Shariah and law. In addition, the banking charges and the decision regarding the interaction of the charitable institutions with it in the Shariah and law. Also, the donation to the charitable institutions via modern methods in the Shariah and law and how to secure the capital of the charitable institutions and its provisions in the Shariah and law and the censorship on the <br/> |
