| Summary, etc. | يمثل الإرهاب هاجسًا يعيشه الدول والشعوب و يهدد أمنهم واستقرارهم، حيث بدأ الإرهاب على المستوى الوطني ثم ما لبث اتخاذه بعدًا دوليًا وأصبح عابرًا للدولِ والقارات، وإدراكًا من واضعي التشريعات لمدى خطورة ظاهرة الإرهاب فقد اهتم هؤلاء الفقهاء بدراسة هذا الموضوع بكافة الآليات اللازمة لمكافحته؛ ولما كان سيف القانون هو أحد أهم الأساليب اللازمة لمكافحة مثل هذه العمليات بمختلف صورها، فقد سارعت الدول التي أضيرت من جراء العمليات الإرهابية إلى سن التشريعات العقابية التي تتناسب مع خطورة تلك العمليات لعدم كفاية النصوص العقابية الموجودة من أجل مكافحتها،وفي إطار ذلك نظمت جمهورية مصر العربية قانونًا خاصًا لمكافحة الإرهاب على عكس العديد من الدول التي اكتفت بتنظيم جرائم الإرهاب في تشريعاتها العقابية. ومن ثم وجهنا الضوء من خلال دراستنا على دور التشريع المصري في التصدي لتلك الظاهرة مقارنةً بالتشريعات الأخرى في الدول ذات السبق الحضاري والديمقراطي كلما أمكن ذلك، فضلًا عن تناول أفضل الاستراتيجيات المضادة لها ووضع رؤية مستقبلية لمكافحة الإرهاب؛من خلال الاستعانة بنهج السياسة الجنائية الرشيدةباعتبارها أساس الأدوات الهامة لمعالجة الأسباب المتنوعة لظهور الإرهاب بل واجتثاثه من جذوره لأقصى حد ممكن. فوفقًا لسياق موضوعنا ”السياسة الجنائية الموضوعية في مكافحة الإرهاب” ارتأينا تمهيد شعاب دراستنا (بفصل تمهيدي) نبحث فيه عموميات هذه الفكرة حول ماهية السياسة الجنائية الموضوعية في مكافحة الإرهاب، ثم طوينا صفحات الدراسة نحو (الباب الأول) حيث تحدثنا فيه عن سياسة تجريم الأعمال الإرهابية؛ ووضحنا من خلاله ماهية الإرهاب،وتحليل القواعد الموضوعية الخاصة بصور الجرائم الإرهابية المنصوص عليها بالقانون رقم 94 لسنة 2015م، وتوضيح البعد الدولي لظاهرة الإرهاب من خلال الاتفاقيات الدولية والإقليمية. ومن ثم طوينا الصفحات نحو (الباب الثاني) الذي وضحنا فيه طرق السياسة الجزائية لمكافحة الإرهاب؛ من خلال اتباع سياسة التشديد تارة على من تثبت مسئوليته عن الجريمة، واتباع سياسة التشجيع والعفو تارة أخرى مع المتعاونين مع العدالة الجنائية، فضلًا عن بيان أهمية التدابير الاحترازية للحيلولة بين من توافرت فيه الخطورة وبين احتمال الإقدام على ارتكاب الجريمة في المستقبل |

| Summary, etc. | Terrorism represents an obsession experienced by states and peoples and threatens their security and stability. Terrorism started at the national level and then took an international dimension and became transnational to countries and continents. Realizing the extent of the danger of the phenomenon of terrorism, these jurists were interested in studying this issue with all the necessary mechanisms to combat it; And since the sword of law is one of the most important methods necessary to combat such operations in their various forms, the countries that have been harmed as a result of terrorist operations hastened to enact punitive legislation that is commensurate with the seriousness of those operations, due to the insufficiency of existing punitive texts to combat them. Arab Egypt has a special law to combat terrorism, unlike many countries that have been content with regulating terrorist crimes in their punitive legislation.<br/>Then, through our study, we shed light on the role of Egyptian legislation in addressing this phenomenon compared to other legislation in civilized and democratic countries whenever possible, as well as addressing the best counter strategies and developing a future vision for combating terrorism; By using the rational criminal policy approach as the basis of the important tools to address the various causes of the emergence of terrorism, and even eradicate it from its roots to the maximum extent possible.<br/>According to the context of our topic, we decided to pave the way for our study (with an introductory chapter) in which we discuss the generalities of this idea about what is the objective criminal policy in combating terrorism, then we turned the pages of the study towards (chapter one) where we talked about the policy of criminalizing terrorist acts; Through it, we explained the nature of terrorism, analyzed the objective rules related to the images of terrorist crimes stipulated in Law No. 94 of 2015 AD, and clarified the international dimension of the phenomenon of terrorism through international and regional agreements. Then we folded the pages towards (chapter Two), in which we explained the methods of the penal policy for combating terrorism; By adopting a policy of stressing at times on those proven responsible for the crime, and following a policy of encouragement and forgiveness at other times with those who cooperate with criminal justice, as well as clarifying the importance of precautionary measures to prevent those who are dangerous and the possibility of committing the crime in the future. |
