| Summary, etc. | إذا كان مبدأ سلطان الإرادة يقضى بأن العقد شريعة المتعاقدين مما يعطى الحق للمتعاقدين أن يضمَّنا عقدهما ما يشاءان من الشروط طالما كانت غير ممنوعة قانوناً. فإن تطبيق هذا المبدأ على إطلاقه قد يجافي العدالة، لا سيما في العقود التي لا تتساوى فيها المراكز القانونية – كعقود الإذعان – والتي غالبا ما يلجأ فيها الطرف القوي إلى فرض شروط تعسفية. ذلك أنه قد يخلق اتفاق الطرفين عقدا غير متناسب، لكونه غير متوازن بشكل واضح على حساب أحدهما. هنا تنشأ مشكلة العدالة العقدية. حيث يثور التساؤل حول ما إذا كان يجب التمسك بما تم الاتفاق عليه بغض النظر عن الظلم الحاصل، أم يجب أن تتدخل سلطة خارجة عن الأطراف المتعاقدة – في الصورة التقليدية – لتصحيح ما وقع به من ظلم ؟ نتفق مع البعض أن إجابة هذا السؤال تكون في ضوء ما يمثله الشرط التعسفي- سواء بذاته أو وفقا لطريقة وظروف تطبيقه-من اختلال في التوازن العقدي بين الأداءات المتقابلة، الأمر الذي يتعارض مع مقتضيات العدالة التي ينبغي أن تسود العلاقات التعاقدية. مما تضحى معه مواجهة الشروط التعسفية في عقود الإذعان بمثابة حماية للطرف الضعيف في الرابطة العقدية، فهي تحمى اختياراته ورغباته. ذلك أن التفاوت في مراكز المتعاقدين، وانفراد الجانب القوى منهما بفرض شروط لا يقبل فيها مناقشة، أمر ليس في الوسع تجاهله. فيكون من العدالة إذن أن ينص القانون على وسائل كافية لحماية الطرف الضعيف. |

| Summary, etc. | If the principle of willpower states that the contract is the law of the contracting<br/>parties, which gives the contracting parties the right to include in their contract whatever<br/>conditions they want as long as they are not prohibited by law. The application of this<br/>principle to its release may prejudice justice, especially in contracts in which legal<br/>positions are not equal - such as contracts of submission - and in which the strong party<br/>often resorts to imposing arbitrary conditions.<br/>The agreement of the two parties may create a disproportionate contract, as it is<br/>clearly unbalanced to the detriment of one of them. Here arises the problem of nodal<br/>justice. where the question arises as to whether it is necessary to stick to what was<br/>agreed upon regardless of the injustice that occurred, or should an authority outside the<br/>contracting parties intervene - in the traditional image - to correct the injustice<br/>committed against it?<br/>We agree with some that the answer to this question is in light of what the<br/>arbitrary condition represents - whether by itself or according to the method and<br/>conditions of its application - of an imbalance in the nodal balance between the opposite<br/>performances, which contradicts the requirements of justice that should prevail in<br/>contractual relations. Thus, confronting the arbitrary conditions in the contracts of<br/>submission becomes a protection for the weak party in the contractual bond, as it<br/>protects his choices and desires. This is because the disparity in the positions of the<br/>contracting parties, and the isolation of the strong side of them by imposing conditions<br/>in which no discussion is acceptable, is something that cannot be ignored. It would be<br/>fair, then, for the law to provide sufficient means to protect the weak party. |
