| Summary, etc. | يعد المستهلك بمفهومه الواسع كل شخص يحصل على السلعة أو الخدمة بقصد إشباع حاجاته الشخصية أو العائلية وليس بغرض مهني أو تجاري، وهو الطرف الضعيف في علاقته التعاقدية مع المهني المحترف بحيث تتعدد مظاهر الضعف التعاقدي للمستهلك كعدم معرفته بمضمون العقد أو جهله بمعلومات عن الخدمة أو السلعة أو لعدم أهليته في التعاقد. ويتوجب لاكتساب صفة التاجر المهني المحترف في إطار الحماية القانونية للمستهلك أن يمارس المتعاقد مع المستهلك أعمال تجارية موضوعية بصفة احترافية ولو كانت هذه الأعمال بذاتها أعمالا إنتاجية أو استهلاكية. كما ينبغي أن تشكل الممارسة الاحترافية والمستمرة للأعمال التجارية الموضوعية حرفة حقيقية للتاجر المتعاقد مع المستهلك وليس القيام بمهمة أو عملية شراء واحدة. وقد اعتمدت محكمة النقض الفرنسية لتعريف المستهلك الجدير بالحماية على معيار تأثير السلعة أو الخدمة في السلوك الاقتصادي للمستهلك، للوصول إلى الغرض من الاستهلاك، بينما تنتفي صفة المستهلك أمام محكمة العدل الأوربية لمن يقتني السلع أو الخدمات لممارسة نشاط مهني في المستقبل. أوصت الدراسة ب ضرورة جمع شتات النصوص القانونية المتناثرة في التشريعات المدنية والتجارية والقوانين الخاصة بحماية المستهلك في سبيل توفير حماية قانونية أمثل للمستهلك، وبناء إطار تشريعي استهلاكي موحد في صورة مدونة خاصة منظمة لقضايا وعقود الاستهلاك على مستوى دول مجلس التعاون الخليجي. |

He is every person who obtains a good or service with the intention of satisfying his personal or family needs and not for a professional purpose.There are many manifestations of the consumer’s contractual weakness, such as: his lack of knowledge of the content of the contract, his ignorance of the service or commodity information, and his inability to contract.In order to acquire the status of a professional trader within the framework of the legal protection of the consumer, the contractor with the consumer must practice business in a professional manner.The professional practice of business should constitute the true craft of the contracted-consumer trader.The French Court of Cassation adopted the criterion of the effect of a good or service on the economic behavior of a consumer worthy of protection.Consumer status before the European Court of Justice ceases for those who acquire goods or services to engage in a professional activity in the future.The study recommended the necessity of collecting the various legal texts regulating consumer protection in a unified framework in Egypt and the countries of the Cooperation Council for the Arab States of the Gulf. |
