| Summary, etc. | قاعدة التحسين والتقبيح العقلي من المسائل الغامضة في أصول الفقه، وقد كَثُر الخلاف في تحرير محل النزاع فيها، وهي في الأصل من المسائل الكلامية، لكنها تدرس في أوائل كتب أصول الفقه، وقد خرّج بعض العلماء على الخلاف في هذه القاعدة مسائل فقهية بين المذهب الحنفي والمذهب الشافعي، وقد هدف البحث إلى توضيح ماهية التحسين والتقبيح العقلي بالنسبة للاستدلال الفقهي، وتحرير محل النزاع في المسائل الفقهية التي ادعي انبناؤها على التحسين والتقبيح العقلي لاستنباط منهج العلماء في الاستدلال العقلي، واستنباط قواعد لاستخدام التحسين والتقبيح العقلي في الحكم على بعض النوازل الفقهية. |
