| Summary, etc. | تتلخص هذه الدراسة في فقه الأسرة على المعتمد من مذهب متأخري الحنابلة مقارنة مع آراء المذاهب الأربعة المعتمدة، بالإضافة إلى مذهب:الظاهرية، والزيدية، والإباضية والجعفرية، فذكرت في كل مسألة: مفردات المسألة -عند عدم الوضوح-، مكتفيًا بما اصطلح عليه المذهب الحنبلي، والروايات الواردة في المسألة، وإثبات اختلاف الرواية فيها مع تحرير المعتمد، وذكر أقوال الفقهاء في كتب المذاهب مع أدلة الأقوال وبيان وجه الاستدلال من الأدلة ومناقشتها وما أجيب به عنها، مع بيان سبب الاختلاف، وذكرت رأي قانون الأحوال الشخصية الكويتي، مع اقتراح مادة قانونية عند عدم وجود نص قانوني في المسألة، مع الترجيح وبيان سببه، ورتبتُ مسائل البحث وفق ترتيب ابن قدامة في المقنع. |
