| Summary, etc. | This research aims specifically at dealing with problems of the ambiguity of the lexis meaning variability in translating legal concepts of the language of international migration agreements, concerning crisis in the field of migration, asylum seeking, and internal displacement affairs, from English into Arabic. The meaning of such concepts, especially some terms of IOM, usually varies in accordance with its contextual framework throughout varied legal systems of different settings or states in the world. Thus, in dealing with the concepts of the legal language of contracts or agreements, the terms are subdivided into two categories: technical and non-technical terms. The first type is defined as specialized terminologies of IOM and UNHCR glossaries related to the subject matter in question. The second type is known as non-specialized words which might be utilized in any variety with the same basic meaning of the subject matter. The study contends that the strategy of “oblique translation”, rather than the strategy of “direct translation”, resolves ambiguity and tackles problems of the lexis meaning variability in translating legal concepts pertaining to the language of international migration agreements. The case study is mainly based on a translation of an international migration agreement, in addition to a draft agreement done by the researcher himself and analyzing the translated texts on the basis of Vinay and Darbelnet’s model. The first agreement is held between Iraq and UNHCR in 2018 while the second draft agreement has not yet been finalized for being a preparatory legal document. It is originally written as a standard formula of an agreement between the EU and Turkey in 2014, translated into about 22 languages except Arabic, and then reformulated to be signed between Iraq and Turkey. The study concluded that the strategy of oblique translation succeeds in solving the problem of ambiguity of the lexical meaning variability to a large extent. |

| Summary, etc. | يهدف البحث الى معالجة مشكلات الغموض في ترجمة المفاهيم القانونية الخاصة بلغة الاتفاقيات الدولية للهجرة بشأن أزمة الهجرة واللجوء والنزوح الداخلي نتيجة التغير في معنى بعض المفردات عند الترجمة من الإنكليزية الى العربية وفقًا لسياق النظام القانوني لدول العالم . فالمعنى لكل مفردة او مصطلح في النص القانوني يحدده المضمون وليس الشكل بصيغته اللغوية . بعبارة أخرى ، تُفَسَّرْ كل مفردة في هذا المجال وفقًا لسياقها القانوني . عند الوقوف على مفاهيم اللغة القانونية بهذا المجال تنقسم مفرداتها الى جزئين : مفردات تقنية (Technical terms) وغير تقنية (Non-technical terms). يعرف النوع الأول بالمصطلحات الخاصة بقواميس منظمة الهجرة الدولية (IOM) والمفوضية السامية للأمم المتحدة لشؤون اللاجئين (UNHCR) . اما النوع الثاني فهو عبارة عن مفردات عامة يمكن استخدامها في عدة مجالات وبالمضمون ذاته في الموضوع مدار البحث. يشير البحث الى تطبيق استراتيجية الترجمة اللاحرفية (oblique translation) بدلا من استراتيجية الترجمة الحرفية (direct translation) في حل تلك مشكلات. يتناول مشروع البحث ترجمة الباحث شخصيا لاتفاقية دولية ومسودة اتفاقية دولية بشأن الهجرة , وتحليل النصوص المترجمة على اساس التطبيق النظري في الترجمة (Vinay & Darbelnet's model) عقدت الاتفاقية بين العراق والمفوضية السامية للأمم المتحدة لشؤون اللاجئين (UNHCR) في عام 2018. اما مسودة الاتفاقية فهي عبارة عن صيغة قانونية اعدتها مفوضية الاتحاد الاوربي ثم عُقِدَت بينها وبين تركيا في عام 2014. اعتمدت هذه المسودة بعد ذلك لدى الجانبين العراقي والتركي للتوقيع عليها لاحقا . توصل البحث الى ان الترجمة اللاحرفية قد نجحت نجاحًا كبيرًا في حل مشكلة الغموض في تغيير المعنى عند ترجمة مفردات المفاهيم القانونية. |
