| Summary, etc. | تتناول هذه الدراسة القضايا الجنائية من كتاب الفتاوى المهدية في الوقائع المصرية لشيخ الحنفية في مصر الشيخ محمد المهدي العباسي شيخ الأزهر ومفتى الديار المصرية الأسبق ، تسلط الضوء على اعتماده على الفتوى بالمفتى به في المذهب الحنفي في القضايا الجنائية المعروضة عليه في فترة امتدت لأكثر من خمسين عاما ، وهي فترة مهمةمن تاريخ التشريع المصري تقاطعت مع ظهور المحاكم المختلطة والمحاكم الأهلية ، وتمتاز هذه القضايا بأنها جمعت بين ما هو موضوعي وما هو إجرائي ، وكان حكم الشيخ المهدي عليها بالموافقة لحكم القاضي أو تعديله أو الإجابة عن تساؤل مطروح من القاضي ، وقد تناولت هذه الدراسة بحث هذه القضايا مقارنا بين المذاهب الفقهية الأربعة |

| Summary, etc. | This study deals with criminal cases from Al-Fatwa Al-Mahdiyyah book published in the Egyptian Chronicles of the Hanafi Jurisprudence School Sheikh in Egypt, Sheikh Muhammad Al-Mahdi Al-Abbasi, Sheikh of Al-Azhar and the former Grand Mufti of Egypt. It highlights on his reliance on the advisory opinion of the Hanafi Jurisprudence School in criminal cases brought before him over more than fifty years. It is an important period in the history of Egyptian Legislation that intersected with the emergence of mixed courts and civil courts. These cases are characterized by the fact that they combined what is objective and what is procedural. Sheikh Al-Mahdi’s ruling on them was in agreement with the judge’s ruling or amending it or answering a question posed by the judge. This study had these issues examined by comparing the four schools of jurisprudence |
