| Summary, etc. | تناولت هذه الرسالة موضوعا هاما من موضوعات المعاملات المالية المعاصرة، وهو: صيغ التمويل في المصارف الإسلامية وأثر المانع في هذه الصيغ، فبين البحث ماهية هذه الصيغ، وأنواعها، وصورها، ومجالاتها، وتكييفها الفقهي، وحكمها الشرعي، وضوابطها الشرعية، ومنافذَ الربا إليها، وكيفية تأثير المانع على أحكامها، مركزا على الصيغِ الرئيسةِ المعروفةِ والمتداولةِ في هذه المصارفِ، التي ترجع إليها أيُّ صيغةٍ أخرى. اتبعت الدراسة منهجًا استقرائيًا تحليليًا، يؤصلُ لموضوعِ المانعِ، فيبينُ حقيقتَه والمقصودَ منه، ويوضحُ أقسامَه والعَلاقةَ بينه وبين السببِ والشرطِ، ويبينُ أثرَه على صيغِ التمويلِ فى المصارفِ الإسلاميةِ، والكيفيةَ التى يتم بها ذلك التأثيرُ، والراجحَ من الآراءِ فى هذه الصيغِ، ويكشفُ مواطنَ مانعِ الربا فى صيغِ التمويلِ المصرفيةِ، ومنافذَه إليها. والبحثُ فى ذلك ينسبُ كلَّ رأىٍ إلى صاحبِه، ويعزو كلَّ قولٍ إلى قائلِه، مقتصرا على المذاهبِ الأربعةِ المشهورةِ، فلا يعدوها إلى غيرِها إلا لضرورةٍ أو فائدةٍ. |

| Summary, etc. | This thesis dealt with an important topic among the topics of contemporary financial transactions, which is: financing formulas in Islamic banks and the effect of the impediment in these formulas. The research explained the nature of these formulas, their types, forms, fields, their jurisprudential adaptation, their legal ruling, their legal controls, the outlets for usury, and how to access them. The influence of the obstacle on its rulings, focusing on the main formulas known and circulated in these banks, to which any other formula refers. The study followed an inductive and analytical approach, which establishes the subject of the prohibition And its impact on financing formulas in Islamic bank. |
