| Summary, etc. | تدور هذه الرسالة حول " النظام القانوني للتنفيذ الجبري على المحل التجاري - دراسة مقارنة " وتنقسم الدراسة فيها إلى فصل تمهيدى وثلاثة أبواب يتناول الفصل التمهيدي التطور التاريخي والتشريعي للتنفيذ الجبري على المحل التجاري في مبحثين. وقد تناول الباب الأول المحل التجاري ومدى قابليته للتنفيذ الجبري وذلك في فصلين تناول في الأول منهما ماهية المحل التجاري وفي الفصل الثاني قابلية المحل التجاري للتنفيذ الجبري. وفى الباب الثانى والذى تم تقسيمه إلى ثلاثة فصول وقد تناول في الأول المحكمة المختصة بإصدار الأمر بالتنفيذ الجبري على المحل التجاري وإجراءات تقديمه وفي الفصل الثاني إصدار الأمر ببيع المحل التجاري وحجيته وفي الفصل الثالث النظام الإجرائي لتنفيذ الأمر الصادر ببيع المحل التجاري وتوزيع حصيلته. وفي الباب الثالث تناولت الدراسة في فصلين، تناول الأول منهما طبيعة عمل القاضي المتعلق بالتنفيذ الجبري على المحل التجاري وفي الفصل الثاني المنازعة في الأمر الصادر ببيع المحل التجاري، والطعن على الحكم الصادر فيه. |

| Summary, etc. | This thesis is about “The Legal System for Compulsory Enforcement at Commercial Business - A Comparative Study.” The study is divided into an introductory chapter and three sections. The introductory chapter deals with the historical and legislative development of Compulsory enforcement at commercial business in two sections. The first chapter dealt with the commercial business and the extent of its susceptibility to Compulsory enforcement in two sections, the first of which dealt with the nature of the commercial business and in the second section the commercial business’ susceptibility to Compulsory enforcement. In the second section, which was divided into three chapters, the first dealt with the competent court competent to issue the order for forced execution on the commercial business and the procedures for submitting it, in the second chapter the issuance of the order to sell the commercial business and its validity, and in the third chapter the procedural system for implementing the order issued to sell the commercial business and distributing its proceeds. In the third chapter, the study dealt with in two sections, the first of which dealt with the nature of the judge’s work related to forced execution on the commercial business, and in the second section, the dispute over the order issued to sell the commercial business, and the appeal against the ruling issued therein. |
