| Summary, etc. | تناولت هذه الرسالة موضوع عقد النقل الدولي في نطاق القانون الدولي الخاص، حيث تمت معالجته من خلال فصل تمهيدي وثلاث أبواب رئيسية، اهتم الفصل التمهيدي بتوضيح ماهية عقد النقل الدولي، في حين عالج الباب الأول تحديد القانون الواجب التطبيق على عقد النقل الدولي، إذ اشتمل هذا الباب على فصلين، تناول الفصل الأول تحديد القانون الواجب التطبيق على عقد النقل الدولي أمام القضاء الوطني، أما الفصل الثاني تناول تحديد القانون الواجب التطبيق على عقد النقل الدولي في مجال التحكيم الدولي. وتضمن الباب الثاني بيان نطاق القانون الواجب التطبيق على عقد النقل الدولي من خلال فصلين، عالج الفصل الأول منهما المسائل الخارجة عن نطاق القانون الواجب التطبيق على عقد النقل الدولي، وهي الشكلية والأهلية، والبضائع المنقولة، في حين تناول الفصل الثاني المسائل الخاضعة للقانون الواجب التطبيق على عقد النقل الدولي، أي المسائل التي تتعلق بموضوع عقد النقل الدولي. وتناول الباب الثالث استبعاد القانون الواجب التطبيق على عقد النقل الدولي من خلال فصلين، حيث عالج الفصل الأول دور النظام العام والقواعد ذات التطبيق الضروري في إطار عقد النقل الدولي، في حين عالج الفصل الثاني دور القواعد الموضوعية أو المادية في إطار عقد النقل الدولي. |

| Summary, etc. | This thesis dealt with the subject of the international contract of carriage within the scope of private international law, which was dealt with through an introductory chapter and three main chapters. The introductory chapter was concerned with clarifying the nature of the international carriage contract, while the first chapter dealt with determining the law applicable to the international carriage contract, as this included The chapter has two chapters. The first chapter deals with determining the law applicable to the international carriage contract before the national judiciary, while the second chapter deals with determining the applicable law to the international carriage contract in the field of international arbitration. The second chapter included an explanation of the scope of the law applicable to the international carriage contract through two chapters, the first of which dealt with issues outside the scope of the law applicable to the international carriage contract, namely formality, legal capacity, and transported goods, while the second chapter dealt with issues subject to the law applicable to the contract. International contract of carriage, i.e. matters relating to the subject matter of the international contract of carriage. The third chapter dealt with the exclusion of the law applicable to the international carriage contract through two chapters. The first chapter dealt with the role of public order and the rules with necessary application within the framework of the international carriage contract, while the second chapter addressed the role of substantive or material rules within the framework of the international carriage contract. |
