| Summary, etc. | الهدف من الرسالة هو البحث عن نظام قانوني يحكم استخدام المياه الجوفية العابرة للحدود الدولية، لذا حددنا أهم ثلاثة التزامات في مجال المياه الدولية وهم: الالتزام بالاستعمال المنصف والمعقول، والالتزام بعدم إحداث ضرر جوهري، والالتزام بالتعاون، وبعد أن درسنها أنزلنا هذه المبادئ الثلاثة منزل التطبيق على دول خزان الحجر الرملي النوبي الجوفي والذي يُعد من أكبر خزانات المياه الجوفية في العالم، وأبرزنا صورة التعاون التي تجلت بين دول الخزان الأربعة وهى بإنشاء "الهيئة المشتركة لدراسة وتنمية خزان الحجر الرملي النوبي"، ووضع لائحة خاصة شملت معظم بنود وأحكام التعاون التي نسعى لتحقيقها.<br/>وحيث تشهد منطقة خزان الحجر الرملي النوبي الجوفي العديد من النزاعات المسلحة، لاسيما في ليبيا والسودان فكان لازما علينا أن نظهر ما يجب أن تتمتع به مياه الخزان الجوفي من حماية قانونية دولية أثناء النزاعات المسلحة، بما يضمن استدامتها ولا تؤثر على حياة الشعوب أو تستخدم في القضاء على الأطراف المعادية.<br/>وحيث قد تنشب بين الدول الأربعة منازعة بحاجة للفصل بسبب استخدام مياه الخزان بنسب متفاوتة، لذا أوردنا طرق تسوية المنازعات المائية بين الدول بشكل عام، وانتهينا إلى إنه طالما لا يوجد اتفاق مسبق بين دول الخزان الأربعة يخص كيفية تسوية هذه المنازعات فضلاً عن خلو لائحة الهيئة المشتركة لتنمية الخزان الجوفي من مثل هذا البند، فيكون للأطراف إعمال نص المادة (33) من ميثاق الأمم المتحدة، بحيث يمكن اختيار أيًّا من الوسائل المنصوص عليها.<br/> |

| Summary, etc. | This thesis aims to look for a legal system governs the utilization of transboundary groundwater; hence, we identified the three main obligations relevant to the international water scope which are: Equitable and Reasonable Utilization, Not to cause significant harm, and Cooperation among countries. After studying each of those obligations we applied them on the countries of “the Nubian Sandstone Aquifer Waters” which considers one of the largest aquifers in the world, highlighting the fruitful cooperation done between the four countries which led to the establishment of the “Joint Authority for the Study and Development of the Nubian Sandstone Aquifer Waters” stating its bylaw. <br/><br/>Since the region of the Nubian Sandstone Aquifer Waters suffers from many armed conflicts, specially in Libya and Sudan, it becomes vital to highlight the importance to internationally govern the Nubian Sandstone Aquifer Waters during any armed conflict to ensure its sustainability and not to impact the people’s life or to be used to eliminate enemies. <br/><br/>Since, the four countries are utilizing the aquifer water in different manner and shares, thus, disputes may arise amongst them, so we mentioned the international water dispute settlement ways, concluding that in case there is no prior agreement between the four countries regarding the dispute settlement mechanism, specially the “Joint Authority for the Study and Development of the Nubian Sandstone Aquifer Waters” bylaw doesn’t regulate such case, then the parties may apply article (33) from the UN charter and choose any of them. <br/><br/> |
