| Summary, etc. | تناولت الدراسة شرح تفصيلي لضمانات المتهم في مرحلة المحاكمة الجنائية في صورة دراسة مقارنة بين القانون الجنائي الإماراتي والمصري، حيث تعرضت الدراسة للضمانات والحقوق التي تحفظ للمتهم حقه في درء التهم المنسوبة إليه، والدفاع عن نفسه بأي طريق كان، وكيف يتحقق للمتهم الحماية مما يمكن أن يتعرض له من انتقاص من الحرية أو مساس بحقوقه من خلال الإجراءات الجنائية، وما يرافقها من مخاطر على حريته وكرامته، وهو في صدد توجيه الاتهام إليه.<br/>ثم ألقت الدراسة الضوء - من خلال التشريعات المقارنة والاتفاقيات الدولية - على الحقوق التي يتمتع بها المتهم في مرحلة المحاكمة الجنائية..<br/>وقدمت الدراسة بعض المقترحات التي من شأنها تساعد في كفالة ضمانات المتهم في مرحلة المحاكمة الجنائية.<br/>وتوصلت الدراسة لبعض النتائج اهمها :<br/>- أن الإعلان العالمي لحقوق الإنسان قد نجح في تحقيق أهدافه، ومنها وقف انتهاكات حق المتهم في محاكمة عادلة منصفة وسريعة، وما يدل على ذلك هو التطبيق العملي لها، واحترام الدول الأطراف لها عن طواعية وعن اقناع بحيث أصبحت مظهرًا من مظاهر التقدم الأساسية البارزة في مجالات العلاقات الدولية.<br/>- أنه يوجد الكثير من النصوص القانونية في القانون المصري والإماراتي تضمنت حقوق المتهم في مرحلة المحاكمة الجزائية، وهذا يدل على أن المشرع المصري والإماراتي قد أبديا اهتمامًا وحرصًا شديدين على حماية حق المتهم في الدفاع واحترام حرياته وحقوقه المختلفة.<br/> |

| Summary, etc. | The study dealt with a detailed explanation of the guarantees for the accused during the criminal trial stage in the form of a comparative study between the UAE and Egyptian criminal law. The study dealt with the guarantees and rights that preserve the accused’s right to ward off the charges against him and defend himself in any way, and how the accused is protected from what he might be exposed to. He has been subjected to a deprivation of his freedom or an infringement of his rights through criminal procedures, and the accompanying risks to his freedom and dignity, and he is in the process of being charged.<br/>The study then shed light - through comparative legislation and international agreements - on the rights enjoyed by the accused during the criminal trial stage.<br/>The study presented some proposals that would help ensure guarantees for the accused during the criminal trial stage.<br/>The study reached some results, the most important of which are:<br/>- The Universal Declaration of Human Rights has succeeded in achieving its goals, including stopping violations of the right of the accused to a fair, just and speedy trial. This is evidenced by its practical application and the voluntary and convincing respect of States Parties to it, such that it has become a manifestation of basic and prominent progress in the fields of International Relations.<br/>- There are many legal texts in Egyptian and Emirati law that include the rights of the accused during the criminal trial stage, and this indicates that the Egyptian and Emirati legislators have shown great interest and keenness to protect the accused’s right to defense and respect his various freedoms and rights.<br/> |
