| Summary, etc. | قدمت الدراسة تأصيلاً قانونياً وفقهياً لنظام المحاكمة عن بُعد من خلال استعراض إجراءات المحاكمة الجنائية والمبادئ التي تقوم عليها لتحقيق مبادئ المحاكمة العادلة، من خلال استعراض التشريعات التي اعتمدت هذه النظام سواء في قوانين مستقلة، أو من خلال تعديلات مدخله على قوانين الإجراءات الجنائية، كما تناولت الدراسة حجج الرافضين والمؤيدين لهذه النوعية من المحاكمات، كما فصلت الدراسة الحجج الرافضة والرد عليها، لتظهر في النهاية أن نظام المحاكمة عن بُعد هو نظام جدير بالتطبيق إلا أنه له متطلبات تقنية يجب أن تتوافر لتحقيق فاعليته والمحافظة على مبادئ المحاكمة الجنائية، ولكن في النطاق الافتراضي التي تتم من خلاله، وبالتالي تظهر مصطلحات جديدة كالإعلان الإلكتروني، والحضور الإفتراضي.<br/>وكأي نظام فإنه بطبيعة الحال سيكون له مميزاته وسلبياته التي لا تخلو منها المحاكمات التقليدية، فنظام المحاكمة عن بُعد له آثار ايجابية متعددة تفوق النظم التقليدية في إجراء المحاكمات الجنائية كإختفاءالنظام الورقي واحلال المحررات الإلكترونية بديلا ًعن المستندات الورقية، والسرعة في انجاز اجراءات التقاضي، بالاضافة الى توفر الوقت والجهد والتكلفة فانه يتفادى عيوب الخطوط اليدوية على المستندات الورقية وصعوبة قراءتها ولاسيما من جانب الكتبة، وبهذا النظام يكون النظام القضائي قد حقق نقلة نوعية لمواكبة التطورات التشريعية واستثمار وسائل التقنية العلمية الحديثة لتحقيق أهداف القضاء وتحقيق مبادئ المحاكمة العادلة، وهو ما ينبغي إقراره كنظام بديل للمحاكمات التقليدية. <br/> |

Time, effort and cost, it avoids the defects of handwriting on paper documents and the difficulty of reading them, especially by clerks. With this system, the judicial system has achieved a qualitative leap in keeping pace with legislative developments and investing in modern scientific technology to achieve the goals of the judiciary and achieve the principles of fair trial, which should be approved as an alternative system for trials.
