| Summary, etc. | ظلت الجريمة منذ الأزل بسيطة محلية تحاكى نمط حياة الجماعة الإنسانية، فلا تتعدى حدودها، فإنه في السنوات الأخيرة وما شهده العالم من تغيرات اقتصادية وسياسية واجتماعية هائلة، تلاشت معها حدود عدد غير قليل من الدُول، مما سهل تنقل الأشخاص والبضائع بينها ليصبح العالم تقوم مقام قرية واحدة، كل ذلك أدى إلى تطور الجريمة المنظمة وانتشارها لتصبح عابرة للحدود الوطنية وخطرًا يهدد معظم دُول العالم.<br/>وإزاءَ عجز الدُّول فرادى عن مكافحة الجريمة المنظمة؛ نظرًا لاتساع نطاقها وامتدادها بين دُول متعددة، وصعوبة تتبع أنشطتها الإجرامية التي غالبًا ما تصطدم بعوائق الحدود الوطنية للدُول الأخرى، بات لزامًا على المجتمع الدُّوَليّ أن يبذل قُصَارَى جهده لإيجاد الآليات اللازمة لمكافحة هذه الجريمة وملاحقة مرتكبيها وتقديمهم للعدالة، حيث لجأت الدُّول إلى إبرام العديد من الاتفاقيات الدُوليَّة الرامية نحو مكافحة هذه الجريمة، وأنشأت آليات للتعاون الدُّوَليّ الأمني والقضائي التي تكفل ملاحقة ومعاقبة مرتكبي تلك الجريمة، بيد أن الواقع العملي قد كشف عن وجود بعض المعوقات والتحديات التي تحول دون فعالية التعاون الدُّوَليّ في مجال مكافحة الجريمة المنظمة. ومع تفاقم خطر الإجرام وتأثيره على الجماعة الدُوليَّة عمومًا، وتدويل ظاهرة "الجريمة المنظمة"، يتوجب البحث عن آليات قانونية وأمنية وإجرائية تتناسب مع تطور هذه الجريمة وخصوصيتها ومرونتها، ومع ظهور عصابات الإجرام الدُوليَّ التي أشاعت الرعب بين المواطنين لابتزازهم وأخذ المقابل المالي لحمياتهم وفرضت عليهم قانون الصمت وعدم البوح بمظاهر الجريمة المنظمة التي قد يشاهدونها ترتكب أمام أعينهم، ملحقة في ذلك أضرارًا بالغة في الهياكل الإدارية والمالية للدولة. <br/> |

| Summary, etc. | From time immemorial, crime has remained simple, local, imitating the lifestyle of the human community, and does not exceed its borders. In recent years, and the enormous economic, political, and social changes that the world has witnessed, the borders of quite a few countries have disappeared, which has facilitated the movement of people and goods between them, so that the world becomes a village. One, all of this led to the development of organized crime and its spread to cross national borders and become a threat to most countries of the world. <br/>In view of the inability of individual states to combat organized crime; Given its wide scope and extension between multiple countries, and the difficulty of tracking its criminal activities, which often collide with obstacles on the national borders of other countries, it has become necessary for the international community to make every effort to find the necessary mechanisms to combat this crime, prosecute its perpetrators, and bring them to justice, as countries have resorted to concluding many agreements. The international community aims to combat this crime, and has established mechanisms for international security and judicial cooperation that ensure the prosecution and punishment of the perpetrators of this crime. <br/> |
