Summary: تهدف الدراسة إلى بيان أثر تطور التفسير الفقهي عند المالكية في القرنين السادس والسابع الهجريين، وبيان أثر العلوم القرآنية المباشرة بالاستنباط الفقهي؛ فإن له دورًا ظاهرًا في ضبط الاستنباط الفقهي من القرآن الكريم. ومن أجل ذلك قسم الباحث الدراسة إلى ثلاثة فصول تناول الأول ملامح التفسير الفقهي عند المالكية وفيه ثلاثة مباحث؛ الأول في التعريف بالتفسير الفقهي عند المالكية والثاني في بيان القواعد الأصولية وتطبيقاتها في التفسير الفقهي عند المالكية. أما الثالث فتناول القواعد الفقهية الكبرى وتطبيقاتها في التفسير الفقهي عند المالكية. وتناول الفصل الثاني التطور من ناحية الإضافات والمستجدات. وفيه مبحثان؛ الأول في بيان كيفية إخراج الدخيل، والثاني استعرض منهجية التعامل مع المستجدات. أما الفصل الثالث فتناول مظاهر التطور من ناحية المضمون وتطبيقاته. وفيه ثلاثة مباحث، الأول في ربط الأحكام بمقاصد الشريعة، والثاني في الاجتهاد والتقليد، والثالث تناول الأدلة المختلف فيها في الاجتهاد وتطبيقاتها. واختتم الباحث بخاتمة واشتملت على أهم ما توصلْتُ إليه من نتائج، والتوصيات.Summary: The study aims to demonstrate the impact of the evolution of jurisprudence interpretation in Maliki school in the 6th and 7th Century Hijri, and to indicate the impact of the direct qoranic sciences by devising jurisprudence; It has an apparent role in adjusting the jurisprudence of the Holy Quran. For this purpose, the researcher divided the study into three chapters, Chapter I: The Features of Maliki’s school interpretation of jurisprudence and contained three topics; Topice I: The Definition of The Interpretation of Jurisprudence in Maliki school, Topic II: The statement of fundamentalist rules and their applications in the interpretation of jurisprudence in Maliki school. Topic III: Grand Jurisprudence Rules and its applications in the interpretation of jurisprudence in Maliki school. Chapter II: The Developments of terms and additions. It has Two Topics; Topic I: The Statement of How to get The Intruder out, Topic II: The Methodology for dealing with Developments. Chapter III: The Developments in Terms of Content and its Applications. It contains three Topics, Topic I: Linking Judgements to The Purposes of Sharia Law, Topic II: Jurisprudence and Tradition, Topic III: The Different Evidence in Jurisprudence and its Applications. The researcher concluded with a conclusion containing my most Important Findings and Recommendations.
