وتهدف الدراسة إلى بيان أن التحرش الجنسي بالإناث سلوكًا محرمًا في الشريعة الإسلامية بكافة صوره، وإن كان بعض صور التحرش الجنسي لا تعد جريمة من وجهة نظر القانون. وجاء تناول الموضوع من خلال مقدمة، وتمهيد، وأربعة فصول، وخاتمة. المـقـدمــة: وفيها بيان أهمية الدراسة، وأسباب اختيار الموضوع، وأهداف الدراسة، ومشكلتها، وتساؤلاتها، وحدود الدراسة، ومنهج البحث، وخطته. ثم التمهيد: بعنوان العلاقة بين الرجل والمرأة في الإسلام وضوابطها.. الفصل الأول: الفصل الأول: تعريف التحرش الجنسي في مختلف التشريعات، وأسبابه. ويشتمل على ثلاثة مباحث: المبحث الأول: تعريف التحرش الجنسي في اللغة والفقه والقانون، المبحث الثاني: تمييز جريمة التحرش الجنسي عن الجرائم المشابهة له (الاغتصاب، الفعل المخل بالحياء، التنمر)، المبحث الثالث: أشكال التحرش الجنسي وأسبابه ودوافعه.. الفصل الثاني: الفصل الثاني: أركان جريمة التحرش الجنسي في الفقه الإسلامي، والقانون الوضعي. ويشتمل على مبحثين: المبحث الأول: الركــن المادي والمعنوي للجريمة في الفقه الإسلامي. المبحث الثاني: الركــن المادي والمعنوي للجريمة في القانون المصري. الفصل الثالث: الفصل الثالث: إثبـات جريمـة التحـرش الجنسـي بين الفقه الإسلامي والقانون المصري. ويشتمل على أربعة مباحث: المبحث الأول: الإقرار. المبحث الثاني: البينة (الشهادة). المبحث الثالث: اليمين، والنكول عنها. المبحث الرابع: القرائن.. الفصل الرابع: الفصل الرابع: صور التحرش الجنسي وموقف الشريعة الإسلامية والقوانين الوضعية منها، وكيفية علاج هذه الظاهرة. ويشتمل على ثلاثة مباحث: المبحث الأول: أبرز صور التحرش الجنسي غير الجسدي. المبحث الثاني: أبرز صور التحرش الجنسي الجسدي. المبحث الثالث: كيفية علاج ظاهرة التحرش(تربوياً- دعوياً- إعلامياً- الالتزام بالقيم الدينية والأخلاقية).

This study deals with the provisions of harassment in Islamic jurisprudence and positive law with: (The provisions of harassment are a legal jurisprudential study)
The study aims to show that sexual harassment of females is a prohibited behavior in Islamic law in all its forms, although some forms of sexual harassment are not considered a crime from the point of view of the law.
The subject was addressed through an introduction, a preface, four chapters, and a conclusion.
Introduction: It includes a statement of the importance of the study, the reasons for choosing the topic, the study’s objectives, its problem, its questions, the limits of the study, the research method, and its plan.
Then the preamble: entitled the relationship between a man and a woman in Islam and its controls..
Chapter One: Chapter One: Defining sexual harassment in various legislations, and its causes. It includes three sections: The first topic: the definition of sexual harassment in language, jurisprudence, and law, the second topic: distinguishing the crime of sexual harassment from similar crimes (rape, indecent act, bullying), the third topic: forms of sexual harassment, its causes and motives.
Chapter Two: Chapter Two: The Elements of the Crime of Sexual Harassment in Islamic Jurisprudence, and Positive Law. It includes two topics: The first topic: the material and moral pillar of crime in Islamic jurisprudence. The second topic: the material and moral pillar of crime in Egyptian law.
Chapter Three: Chapter Three: Proving the crime of sexual harassment between Islamic jurisprudence and Egyptian law. It includes four topics: The first topic: Admission.
The second topic: Evidence (testimony). The third topic: the oath, and renouncing it. Fourth topic: Evidence.
Chapter Four: Chapter Four: Images of sexual harassment and the position of Islamic Sharia and man-made laws on them, and how to treat this phenomenon. It includes three sections: The first topic: the most prominent forms of non-physical sexual harassment. The second topic: the most prominent forms of physical sexual harassment. The third topic: How to treat the phenomenon of harassment (educational - advocacy - media - commitment to religious and moral values).
Conclusion: It includes the most important results and recommendations that I reached through my study.
