ينصب البحث حول المحررات الإلكترونية والمنازعة في إثباتها أمام القضاء، فالمحررات الإلكترونية هي رسالة بيانات تتضمن معلومات تنشأ أو تدمج أو تخزن أو ترسل أو تستقبل كلياً أو جزئياً بوسيلة إلكترونية، أو رقمية أو ضوئية أو بأية وسيلة أخري مشابهة.
ومن ثم يتبين أن المحرر الإلكتروني يختلف عن المحرر التقليدي من حيث الوسيلة، فالوسيلة في المحرر التقليدي مادية، أما الوسيلة في المحرر الإلكتروني فهي إلكترونية، أما من حيث الدعامة فالدعامة في المحرر التقليدي هي الورق، أما الدعامة في المحرر الإلكتروني فهي الأقراص المدمجة CD.
وتتميز المحررات الإلكترونية بالسرعة والسهولة في إجراء المعاملات، إلا أنها تثير بعض المشاكل على المستوى التنظيمي والتقني والقانوني، وذلك نظراً لما تثيره من تعقيد وتشابك، وهو الأمر الذي تطلب وسائل تقنية وقواعد قانونية إلكترونية، وهو ما جعل المشرع ينظم هذا النوع من المعاملات مع توفير الحماية اللازمة للمتعاقدين.
وقد كان للصفة الإلكترونية في إبرام المحرر الإلكتروني تأثيرها البالغ في نظامها القانوني، حيث يتم المحرر الإلكتروني عبر وسائط إلكترونية وهو الأمر الذي أدي إلى اختفاء المحررات التقليدية المتمثلة في الكتابة التقليدية ذات الوجود المادي الملموس، وكذا اختفاء التوقيع الخطي التقليدي؛ مما أدي إلى انتقالنا من عالم مادي ملموس إلى عالم مادي غير ملموس.
