Summary: تنتقل الدعوى بعد صدور الحكم القضائي النهائي إلى مرحلة التنفيذ العقابي، وهنا يتغير المركز القانوني للمتهم، فيصبح محكوما عليه؛ وذلك بعد أن كان متهما ويتمتع بسلسلة من الحقوق والضمانات الدستورية والقانونية التي تأتي في مقدمتها قرينة البراءة، تسقط هذه القرينة ليحل محلها واقع آخر جديد، وهو الحكم القضائي النهائي، ولا يعني هذا التغير في الوضع القانوني للمتهم دخول المحكوم عليه في مرحلة تنعدم بها حقوقه، بل إنه يعني دخوله لمرحلة جديدة تتوافر فيها حقوق من نوعية أخرى تتوافق مع متطلبات هذه المرحلة. فيعتبر المحكوم عليه هو الشخص الذي ارتكب جريمة، مما أدى إلى دخوله السجن ليقضي فيه العقوبة المقررة، ولا شك أنها تشكل جريمة بحق المجتمع ككل، وذلك سواء وقعت على فرد أو على مجموعة من الأفراد، ذلك أن أمن المجتمع يحصل من خلال أمن الأفراد الذين يتشكل منهم المجتمع.. Summary: After the final judicial ruling is issued, the case moves to the punitive execution stage, and here the legal status of the accused changes, and he becomes a convict. This is after he was accused and enjoyed a series of constitutional and legal rights and guarantees, the forefront of which is the presumption of innocence. This presumption falls away and is replaced by another new reality, which is the final judicial ruling. This change in the legal status of the accused does not mean that the convict enters a stage in which his rights are lacking. Rather, it means entering a new stage in which rights of a different type are available that are compatible with the requirements of this stage. The convict is considered the person who committed a crime, which led to him being imprisoned to serve the prescribed sentence. There is no doubt that it constitutes a crime against society as a whole, whether it occurred against an individual or a group of individuals. The security of society is achieved through the security of the individuals who constitute it. Among them is society. The truth is that the group of convicts is the result of a combination of many factors in society, and in most cases the motive for committing the crime is the need for money, and these deceived young people often regret it after being thrown into prison.

تنتقل الدعوى بعد صدور الحكم القضائي النهائي إلى مرحلة التنفيذ العقابي، وهنا يتغير المركز القانوني للمتهم، فيصبح محكوما عليه؛ وذلك بعد أن كان متهما ويتمتع بسلسلة من الحقوق والضمانات الدستورية والقانونية التي تأتي في مقدمتها قرينة البراءة، تسقط هذه القرينة ليحل محلها واقع آخر جديد، وهو الحكم القضائي النهائي، ولا يعني هذا التغير في الوضع القانوني للمتهم دخول المحكوم عليه في مرحلة تنعدم بها حقوقه، بل إنه يعني دخوله لمرحلة جديدة تتوافر فيها حقوق من نوعية أخرى تتوافق مع متطلبات هذه المرحلة.
