يستعرض الباحث من خلال هذه الدراسة مُحددات الحماية الجنائية الموضوعية والإجرائية، للموظف العام أثناء وبسبب أدائه لأعمال وظيفته، تلك الحماية الجنائية الرامية إلى تغليب مصلحة جديرة بالحماية وهي حماية الوظيفة العامة، وليس الحماية الشخصية للموظف العام. وتتجلى أهمية هذه الدراسة بالنظر إلى الجانب التطبيقي فيها، بمدارسة تطبيقات عملية يقع فيها رجال الشرطة، من تحديات يومية أثناء ممارسة أعمال وظيفتهم، من اتخاذ قرارات هامة في ظل ضيق وقت وظروف عمل غير عادية باستعمال القوة أو السلاح للحفاظ على النظام والأمن العام، وحماية الأرواح والممتلكات العامة والخاصة، مروراً بحالات الدفاع الشرعي أو تقدير حالة الضرورة للخروج على القواعد الإجرائية، وانتهاءً بتقديمهم للمحاكمة عن بعض تلك الأفعال، مما يرى الباحث معه الحاجة الملحة لبعض التعديلات التشريعية لصياغة مظلة حماية جنائية حقيقية لرجل الشرطة، تكفل له العمل بدون خوف وتردد بما ينعكس إيجاباً على أمن الوطن والمواطن.

Through this study, the researcher reviews the determinations of substantive and procedural criminal protection for public servants during performing their duties, in addition to the outcomes of performing their duties. Criminal protection aims at prioritizing the protection of public service, and not the personal protection of public servants.
The importance of this study is reflected in considering the practical aspect in it, by studying practical applications in which policemen fall, from daily challenges during the exercise of their job duties, from making important decisions in light of limited time and unusual working conditions by using force or weapons to maintain public order and security, and protect lives. And public and private property, passing through cases of legitimate defense or assessing the state of necessity to deviate from the procedural rules, and ending with their being prosecuted for some of these acts, which the researcher sees the urgent need for some legislative amendments to formulate a real criminal protection umbrella for the policeman, to ensure that he works without fear and hesitation with what is reflected Positively on the security of the homeland and the citizen.
