يتناول هذا البحث قضية جهود المرأة في الفقه وأصوله في العصر الحديث، ويظهر من خلاله المفارقة بين الدور الذي أسسته المرأة في القرون الأولى وبين ما وصلنا إليه اليوم. يعرض البحث نماذج لتناول بعض النساء للقضايا العلمية الأصولية كالعام والخاص والنسخ ومسألة تجديد علم أصول الفقه، كما يعرض أيضا نماذج لبعض القضايا الفقهية التي تناولها بالدراسة بعض النساء وذلك مثل تنوع الآلة في أبواب الفقه الإسلامي وحدود سلطة ولي الأمر.
تكشف هذه النماذج عن حقيقة ما إذا كان للمرأة جهد إضافي وإسهام علمي أم لا.

This research is about the contemporary women contributions in jurisprudence and its principles.It shows the gap between the role that women played at the early centuries and their contributions today. The research presents models for some women scholars tackling important issues of jurisprudence principles, for example: al-'Aam wa al-Khas (the general and the specific), al-Naskh (abrogation), and the issue of renewing the science of jurisprudence principles. It further illustrates some jurisprudential issues such as: limitations of guardian authority, and the variant use of instruments in Sharia. such models reveal the truth about
