Summary: يتلخص هذا البحث في النقاط التالية: درء الحدود والقصاص بالشبهة من أدل الدلائل على أن هذف الشريعة الإسلامية هو حماية أمن الأفراد، والمجتمعات. الشبهة تكون مانعة من العقوبة المقدرة على المدعى عليه؛ غير أنها لا تمنع الحاكم من التعزير. اعتبرت الشريعة الإسلامية في تطبيق الحدود، والقصاص – اختلاف الأزمنة، والأماكن، والأشخاص. مماجعلها صالحة لكل زمان، ومكان. وقد تناولت هذه الرسالة الموضوع في أربعة فصول، كل فصل يحتوي على ثلاثة مباحث، ثم نتائج البحث، وتوصياته، ثم الفهارس الفنية. Summary: Warding off hudud and retribution by suspicion is one of the clearest signs that the purpose of Islamic law is to protect the security of individuals and communities. Suspicion precludes the punishment assessed on the defendant, but it does not prevent the ruler from ta'zir. Islamic law is considered in the application of hudud and qisas – the difference in times, places, and persons. This makes it valid for all times and places. This thesis dealt with the subject in four chapters, each chapter contains three sections, then the results of the research, its recommendations, and then technical indexes
