520			_aإن من حق الإنسان أن يحيا حياة إنسانية يتمتع فيها بمجموعة من الحقوق الأساسية اللصيقة بصفته كإنسان ، والصحة تمثل مكانة عالية في حياة البشر ، وتعتبر من أهم حقوق الإنسان وأعلاها قدراً وأبرزها مكانةً ، وربما يتوقف عليها حياة الإنسان كلها . وحقوق الإنسان بصفة عامة لها جذور ضاربة في التاريخ ولقد علت أصوات الفقهاء والمهتمين بحقوق الإنسان وعقدت المؤتمرات وصيغت الإعلانات والاتفاقيات التي تترجم هذه الحقوق ، وصيغت الحقوق المدنية والسياسية كجيل أول من حقوق الإنسان ، ثم تلاها الجيل الثاني وهي الحقوق الاجتماعية والاقتصادية ومن بينها الحق في الرعاية الصحية . وإن أكثر ما يهم الفرد هو أن يكون متمتعاً بحقوقه ، وينبغي أن يمكن منها وهناك حقوق يحتاج فيها إلى معاونة الدولة كي يحصل عليها ، فلا يستطيع الفرد أن يمنع مسببات المرض وتهيئة أسباب الصحة العامة التي تشمل الحفاظ على البيئة بكل عناصرها وغير ذلك من روافد التلوث ، كما لا يستطيع في الغالب الأعم رد غائلة المرض من ماله الخاص ، ومن هنا برزت مسئولية الدولة في كفالة الحق في الرعاية الصحية والصحة العامة . وإزاء اهتمام المواثيق الدولية ومن قبلها الشريعة الإسلامية بهذا الحق فلم يعد مقبولاً صدور دستور في أي دولة حديثة من دون أن يتضمن الحقوق الأساسية للأفراد ومن بينها الحق محل الدراسة ، إذ أن تنظيم الحق عن طريق الدستور يضمن له الثبات والاستقرار ، ويشعر المشرع بسمو هذا الحق وتكريسه من قبل الوثيقة القانونية .

What matters most to the individual is that he enjoys his rights, and he should be able to enjoy them, and there are rights in which he needs the help of the state in order to obtain them. The individual cannot prevent the causes of disease and create the causes of public health that include preserving the environment with all its elements and other tributaries of pollution. In most cases, he cannot repay the disease from his own money, hence the responsibility of the state to ensure the right to health care and public health. And in light of the interest of international covenants, and before them, Islamic law, in this right, it is no longer acceptable to issue a constitution in any modern country without including the basic rights of individuals, including the right under study, as organizing the right through the constitution guarantees stability and stability for it, and the legislator feels the supremacy and consecration of this right. by legal document.
