520			_aتكنولوجيا الاتصالات والحاسوب أحدثت ثورة حقيقية في المعلومات. ومع تراكم المعرفة والمعلومات، نشأت جرائم جديدة تتعامل مع هذا الواقع. وقد اتسمت هذه الجرائم بسمات تقنية وأطلق عليها اسم "جرائم تقنية المعلومات"، توازياً مع "عصر تقنية المعلومات". من بين الأضرار البارزة التي تترتب على المجتمع نتيجة لذلك، استغلال شبكات التواصل الاجتماعي عبر الإنترنت في أغراض جرائمية، والتي تشكل مخاطر اجتماعية وأمنية، بما في ذلك التحريض على قلب نظام الحكم وتهديد أمن الدولة. تواجه الدولة، من خلال سلطات التحقيق وأجهزة العدالة الجنائية، تحديات كبيرة في مواجهة هذه المخاطر والحد منها. لذا، يتعين تحديد شروط استخدام مواقع التواصل الاجتماعي وإلزام المستخدمين بتقديم هويتهم الحقيقية، بالإضافة إلى فرض التزامات على الناشرين ومزودي خدمات الاستضافة. وعلى الجانب الإيجابي، يمكن استغلال شبكات التواصل الاجتماعي لجمع الاستدلالات الجنائية وتحليل محتواها لتحديد العلاقات بين المشتبه فيهم والجرائم التي تنشأ عن استخدام هذه الشبكات. وعلى الرغم من أن هذه الشبكات توفر الجهد والوقت والمال في جمع المعلومات، إلا أنها تُشكل خطرًا على الخصوصية، حيث يمكن الوصول إلى جميع أنواع المعلومات الشخصية الخاصة بالفرد. ولكن من ناحية أخرى، تُمثل هذه الشبكات فرصة حقيقية للشرطة في جمع الاستدلالات عن الجرائم، من خلال تحليل محتوى الشبكات وتحديد العلاقة بين المشتبه فيهم والجرائم الناشئة عن استخدامها.
520			_aCommunications and computer technology have brought about a real revolution in information. With the accumulation of knowledge and information, new crimes emerged that deal with this reality. These crimes were characterized by technical features and were called “information technology crimes,” in parallel with the “information technology era.” Among the notable harms that result to society as a result is the exploitation of online social networks for criminal purposes, which pose social and security risks, including incitement to overthrow the government and threaten state security. The state, through its investigative powers and criminal justice agencies, faces significant challenges in confronting and reducing these risks. Therefore, the terms of use of social media sites must be determined and users must be required to provide their real identity, in addition to imposing obligations on publishers and hosting service providers. On the positive side, social media networks can be exploited to collect forensic inferences and analyze their content to determine relationships between suspects and crimes that arise from the use of these networks. Although these networks save effort, time and money in collecting information, they pose a threat to privacy, as all types of personal information about an individual can be accessed. But on the other hand, these networks represent a real opportunity for the police to collect inferences about crimes, by analyzing the content of the networks and determining the relationship between suspects and crimes arising from their use. In conclusion, “information technology crimes” are a serious phenomenon that requires effective measures by the state and society to reduce their risks, while taking advantage of the capabilities of these networks to collect information and achieve justice.
