ففي بداية وجود البشر فى الكون وبعد أن خلق الله سيدنا آدم ووطأت قدم الإنسان على الأرض وصار يعبث فيها ولدت معه الجريمة، والتي قوامها نشاط بشري عدواني يخالف بحسب الأصل الشرائع السماوية والقيم الأخلاقية؛ كمايمثل اعتداءً على النفس والمال والعرض ومخالفة للقوانين الوضعية ، ومع التطور العلمي وبحث الإنسان عن مكنون الفضاء الخارجي واستعمال وسائل التقنية الحديثة في الاتصالات وفي مجال تكنولوجيا المعلومات والاتصالات.
والذى نتج عنه إحداث ثورة تنموية بشرية على جميع المستوي والأصعدة المحلية والعالمية، وأصبحت عملية تبادل المعلومات والمعارف تتم بسهولة ويسر، فأدي هذا الانتشار السريع للمعلومات عبر وسائل الاتصال المختلفة إلى تدفق المعلومات والأخبار والمعارف وتبادل المحادثات بحرية وسلاسة، وعلى جانب أخر فقد خلف هذا التطور التكنولوجي العديد من المخاطر والأضرار لا سيما مع ضعف الرقابة عليه مما أدي إلى ظهور نوع جديد من الجرائم المتطورة والتي تختلف عن سابقتها من حيث طريقة وأسلوب ارتكابها، وشكل وصفات المجرم وطباعة سميت بالجريمة الإلكترونية أو السيبرانية، وبعدة مسميات أخرى منها جريمة الإنترنت ، والمعلوماتية، وأصبحت تمثل، تهديداً مباشراً وواضحاً للأمن والاستقرار المحلي والعالمي، وعائقاً يحول دون إتمام عملية التطوير والتنمية الاقتصادية والأمنية.
