العقار هو من أهم مفردات ومقومات الثروة العقارية على مستوى الفرد والدولة، وقد أدرك المشرع المصرى أهمية وضع نظام يكفل الحماية الحقيقية للملكية العقارية، ويكون مواكباَ لحرص الدولة على حماية وتأمين الثروة العقارية وخاصة نظام السجل العينى لأنه يترتب على تطبيقه تغيير جذرى فى أنظمة التسجيل القائمة وقت صدوره، ودوره فى استقرار الملكية العقارية، وبموجب القانون رقم 142 لسنة 1964 عمل المشرع المصرى على إدخال نظام السجل العينى للبلاد بجانب وجود نظام الشهر الشخصى ، وتناول ماهية نظام السجل العينى ومفهومه والمبادىء التى يقوم عليها ونشأته وتطوره التاريخى ، ثم تطبيقه على أرض الواقع لأول مرة ، وهو ما يطلق عليه "القيد الأول "، وتعريفه وأنواع القيد ، وكذلك المقصود بالوحدة العقارية والصحيفة العقارية فى القانون المصرى والفرنسى، وكذلك الدفتر العقارى فى الجزائر ، وأسباب كسب الحقوق التى تصلح لإجراء القيد الأول فى السجل العينى، والضمانات المقررة لأعمال هذا القيد، ونتناول كذلك المشكلات القانونية والعملية التى تواجه الإجراءات التحضيرية قبل القيد الأول ، والأخطاء التى قد تقع أثناءعملية القيد الأول أو القيود التالية من خلال تطبيقات عملية من أرض الواقع، والحلول المقترحة لها، والدور الهام الذى تقوم به الإدارة العامة للسجل العينى بمصلحة الشهر العقارى للتصدى لهذا الأمر ، ووضع حلول لها ؛ وذلك حتى تكون هذه الحلول نموذجاً يحتذى به فى المشكلات المماثلة ، ثم نتناول القيد التالى ومحله وإجراءته والضمانات المقررة له والآثار المترتبة عليه، وكذلك نتناول حجية القيد سواء الحجية المطلقة أو النسبية، وأيضاً نتناول المشكلات القانونية والعملية المتعلقة بحجية القيد . Real Estate is among the most valuable elements of wealth whether for individuals or countries. The Egyptian legislator realized the importance of developing a system that ensure a real protection for the real estate property and on the other hand keeps pace with the Country’s keenness to protecting and securing the real estate wealth especially Real Estate Register. Implementing the system of Real Estate Register shall resulted in significant change in the systems of real estate registry, applied at the time when the law number 142 for 1964 was issued, as well as its contribution to the stability of ownership. The Egyptian legislator endeavored, according to the law no. 142 for 1964, to apply the real estate registry in the country besides the personal publicity system. The study identified the real estate register and its meaning, principles, origin, historical development, and first time of field application. It also addressed the “primary registration” and its identification, and types. Furthermore, it has clarified the meaning of real estate unit, real estate sheet in Egyptian and French laws, as well as Algerian real estate register. The study also addressed the causes of acquiring the rights that may be subject to primary registration in the real estate register and the guarantees applied thereof. We have also addressed the legal and practical issues occurred during the preparation procedures which precedes the phase of primary registration, and the proposed solutions. Also, there was a part for the important role of Real Estate Registry Department of the Department of Real Estate Publicity and Registration in facing such issue and developing solutions therefore in order to develop model solutions to be follow in similar issues. We have addressed the subsequent registration and its subject, procedures, applied guarantees, and its implications. Finally, we have addressed the authoritative effect of registration including absolute and proportional authoritative and the related legal and practical issues.
