| Summary, etc. | إن التشكيلات العصابية هي النموذج الأمثل للسلوك الجماعى فى ارتكاب الجريمة، وهو عبارة عن جماعة من المجرمين يكونون فريقًا يجعل من الجريمة وظيفة أو حرفة، بحيث يكون لكل عضو فى العصابة دور يساهم به فى تحقيق الهدف الذى تشكلت العصابة من أجله. الأمر الذي دعا إلى ضرورة انتباه المشرع المصري إلى مواجهة تلك الظاهرة .<br/> وهدفت الدراسة إلى التعرف على بيان النصوص القانونية والأحكام القضائية وبعض الآراء الفقهية في هذا الموضوع ، بما يسمح بوجود استجابة دولية للتصدي لهذه الظاهرة واهتمام التشريعات الجنائية المقارنة بها، والوقوف على مواطن الضعف والخلل فى خطة المشرع المصرى فى مواجهة هذه الظاهرة.<br/> وانتهت الدراسة للعديد من النتائج أهمها: عدم اتسام النموذج القانوني للتشكيلات العصابية في التشريعات العقابية بالدقة والوضوح، وأن النموذج القانوني لجريمة تشكيل العصابة كجريمة مستقلة يتحقق بصور متعددة للسلوك الإجرامي وهي الإنشاء أو التأسيس أو التنظيم أو الإدارة أو الاتصال بالعصابات الإجرامية أو بتقديم المعونة لها.<br/> وخلصت لعدة توصيات منها: ضرورة النص على قانون عقوبات تكميلي لجرائم التشكيلات العصابية نظراً لتزايد خطورتها وتعاظم أثرها، كما أن العصابات غالبا ما يتم تمويلها من الخارج (جهات أجنبية) لذا يجب تركيز جهود الجهات الأمنية على مراقبة هذه الجهات ومدى اتصالها بعناصر داخل البلاد للسيطرة على التشكيل في بدايته.<br/> |

| Summary, etc. | Gang formations are the ideal model for group behavior in committing crime. It is a group of criminals who form a team that turns crime into a job or craft, so that each member of the gang has a role to contribute to achieving the goal for which the gang was formed. Which called for the Egyptian legislator to pay attention to confronting this phenomenon. The study aimed to identify the legal texts, judicial rulings, and some jurisprudential opinions on this subject, allowing for an international response to address this phenomenon and the interest of comparative criminal legislation in it, and to identify the weaknesses and defects in the Egyptian legislator’s plan to confront this phenomenon.<br/>The study concluded with several results, the most important of which are: The legal model for gang formations in penal legislation is not characterized by accuracy and clarity, and that the legal model for the crime of forming a gang as an independent crime is achieved through multiple forms of criminal behavior, namely creation, establishment, organization, management, contact with criminal gangs, or providing aid to them.<br/> It concluded with several recommendations, including: the necessity of stipulating a supplementary penal code for crimes committed by gang formations due to their increasing seriousness and increasing impact, and that gangs are often funded from abroad (foreign parties), so the efforts of the security authorities must be focused on monitoring these parties and the extent of their contact with elements inside the country to control Formation is in its infancy.
