| Summary, etc. | إن مقصود القبض هو القبض؛ لأنه من الأمور الهامة التي التي ينبغي بحثها في المعاملات المالية لما يترتب عليها من الأحكام الشرعية والقانونية، حيث إن قيام المتعاقد بالتسليم وحصول القبض من المتعاقد الآخر هو مقصد المتعاقدين وغايتهم من العقد، والله سبحانه وتعالى يقول في محكم آياته:﴿يَا أَيُّهَا الَّذِينَ آَمَنُوا أَوْفُوا بِالْعُقُودِ﴾( ) والوفاء بها هو القبض، إذ هو ثمارها وفائدتها ويقول ابن تيمية " المقصود من العقود إنما هو القبض والاستيفاء، فإن المتعاقدات تفيد وجوب القبض أو جوازه، بمنزلة إيجاب الشارع، ثم التقابض ونحوه وفاء بالعقود قبل المأمور به في الشرعيات"( )، كما يترتب عليه استقرار المعاملات والعقود، كذلك يعني أن القبض والتسليم أثر من أثار العقد، فإن هناك بعض العقود يتوقف تمامها على حصول القبض والتسليم، وهى العقود التي يطلق عليها العقود العينية وهى" الهبة والرهن الحيازي والقرض والإعارة والوديعة"، وقد ثار جدل بين الفقهاء حول تكيف القبض في هذه العقود هل هو ركن في العقد أم شرط فيه، وهل هو شرط صحة أم شرط نفاذ أم شرط لزوم؟. وفى ظل ما أفرزته التطورات الحديثة من تعاملات عبر الوسائل الحديثة، فكان لزاما الإشارة إلى تلك المستجدات لأهميتها الكبيرة حيث أصبحت المعاملات تتم من خلال تلك الوسائل لذا فقد اشارت الدراسة إلى تعريف القبض عبر الوسائل الإلكترونية الحديثة وأهميته وخصائصه وأركانه وبطاقة الائتمان أنموذجا لهذه التطبيقات. |

| Summary, etc. | The purpose of a contract is receipt (qabd), as it is one of the important matters that should be examined in financial transactions due to the legal and Sharia implications that arise from it. The act of delivery by one contracting party and the receipt by the other contracting party is the intention and goal of the parties involved in the contract. Allah, may He be exalted, says in His decisive verses: "O you who have believed, fulfill [all] contracts" and fulfilling contracts means receipt, as it is their fruit and benefit. Ibn Taymiyyah said, "The purpose of contracts is indeed receipt and fulfillment, for contracts indicate the obligation or permissibility of receipt, as prescribed by the legislator. Then comes the meeting of minds and other such matters, fulfilling contracts before what is mandated by the religious laws" . Furthermore, the stability of transactions and contracts depends on receipt and delivery. It also means that receipt and delivery are among the effects of a contract. Some contracts entirely depend on receipt and delivery, such as contracts known as "commodities contracts," which include gift (hiba), possessory pledge (rahn al-hiyazi), loan (qard), borrowing (i'arah), and deposit (wadi'ah). There has been a debate among scholars regarding the requirement of receipt in these contracts: is it an essential element of the contract or a condition within it? Is it a condition for validity, enforceability, or necessity?<br/>Given the developments in modern transactions through modern means, it is necessary to address these innovations due to their significant importance. Transactions are now conducted through these means. Therefore, the study highlights the definition of electronic receipt and its importance, characteristics, pillars, and credit cards as a model for receipt through modern means.<br/> |
