Summary, etc.	يولد الإنسان على الفطرة السليمة الّتي لا تعرف الاعتداء على الأخر، وتساهم البيئة المحيطة بالإنسان في التأثير على شخصيته، وقد يتعرض بعض الأشخاص لتأثيرات سلبية قد تدفعهم للانحراف عن الطريق الصحيح مما يقودهم إلى الإجرام. وفكرة الجريمة عرفها المجتمع البشري منذ نشأته، وسعى المشرع إلى محاربتها ؛ إلا أنّ الجريمة تبقى واقعةً لا خلاص للمجتمع منها، فهي أمرٌ طبيعي يصاحب تطور المجتمع، وقد سعى المشرع إلى مواجهة الجريمة، من خلال فكرة العقوبة والّتي مرت بعدة مراحل حيث كانت العقوبة في العصر القديم تتضمن شراً يقابل شراً، وكان معيار تحديد العقوبة هو التناسب بين الضرر الّذي أصاب المجني عليه من جراء الجريمة.<br/>وكان القصاص هو السائد وذلك استناداً إلى أن الجريمة تمثل خطيئةً يجب الاقتصاص من مرتكبها لمحو آثارها، لكن هذه النظرة قد تغيرت، وذلك بفضل مبدأ التفريد العقابي، والّذي بفضله تم التحول من التركيز من الجريمة إلى التركيز على المجرم، والّذي لم يعد ينظر إليه كمذنبٍ يجب معاقبته، وإنّما كمريض اجتماعي يجب تخليصه من مرضه، وإعادة إدماجه في المجتمع كشخصٍ مستعدٍ للتعايش معه، ومن أجل الوصول لذلك الهدف منح المشرع للقاضي الجنائي سلطة تفريد العقوبة في إطار القانون.

The idea of crime has been known to human society since its inception, and the legislator sought to combat it. However, crime remains a reality from which society cannot escape, as it is a natural matter that accompanies the development of society. The legislator sought to confront crime, through the idea of punishment, which went through several stages, as punishment in the ancient era included evil corresponding to evil, and the criterion for determining punishment was proportionality between The damage caused to the victim as a result of the crime.<br/> Retribution was prevalent, based on the fact that the crime represents a sin whose perpetrator must be punished in order to erase its traces, but this view has changed, thanks to the principle of punitive individualization, thanks to which the focus has shifted from the crime to focusing on the criminal, who is no longer seen as a guilty person who must Punish him, but as a social patient who must be freed from his illness and reintegrated into society as a person willing to live with it. In order to achieve that goal, the legislator granted the criminal judge the authority to individualize punishment within the framework of the law.
