| Summary, etc. | يتناول هذا البحث المخالفة وأثرها في إعلال الأخبار عند نقاد الحديث، دراسة نقدية مع بيان الأثر الفقهي، لبيان مفهوم المخالفة وأسباب وقوعها والكشف عنها، وبيان أنواع المخالفة في المتن والأسناد، وكذلك صور المخالفة وأثرها في اختلاف الفقهاء، وذلك من خلال المنهج الوصفي التحليلي.<br/>وذلك للوصول إلى مجموعة من النتائج، من أهمها:<br/>1- معرفة المخالفة في المتون والأسانيد داخل في علم العلل الذي هو كالميزان لبيان الخطأ والصواب والصحيح والمعوج؛ إذ هي من القضايا التي اعتنى بها المحدثون عناية كبيرة.<br/>2- ينشأ عن المخالفة: الاضطراب؛ إذا تساوت الوجوه، ولا مرجح، أو الشذوذ؛ إذا كان المخالف ثقة، قد خالف من هو أوثق، أو أكثر أو أرجح منه، أو النكارة؛ إذا كان المخالف ضعيف، قد خالف الثقات، وقد تكون صورة المخالفة عبارة عن زيادة من ثقة.<br/>3- لكل من أئمة الحديث والفقه طريق غير طريق الآخر، فإن الذي تقضيه قواعد الأصول والفقه أن العمدة في تصحيح الحديث عدالة الراوي، وجزمه بالرواية، وأهل الحديث قد يروون الحديث من رواية الثقات العدول ثم تقوم لهم علل تمنعهم عن الحكم بصحته.<br/>4- النظر العميق في التعرف عَلَى الاختلافات في المتون والأسانيد لَهُ أهمية بالغة للفقيه فضلاً عن المحدِّث؛ لأن الفقيه لا يستطيع أن يعرف صحة الحديث من عدمها حَتَّى يقر في نفسه ويعتقد أنّ هَذَا الْحَديث خالٍ من الخلل والوهم بسبب الاختلافات<br/> |

| Summary, etc. | This research deals with the violation and its effect in explaining the news according to hadith critics, a critical study with an explanation of the jurisprudential impact, to explain the concept of the violation and the reasons for its occurrence and detection, and to explain the types of violation in the text and the chain of transmission, as well as the forms of violation and its impact on the differences of jurists, through the descriptive and analytical approach.<br/>In order to reach a set of results, the most important of which are:<br/>1- The violation results in: disturbance; If the faces are equal, and there is no bias or anomaly; If the violator is trustworthy, he has disagreed with someone who is more trustworthy, more reliable, or more likely than him, or someone who is indecent; If the violator is weak, he has violated trustworthy people, and the form of violation may be an increase from a trustworthy person.<br/>2- Each of the imams of hadith and jurisprudence has a path different from the path of the other. What is stipulated by the rules of jurisprudence and jurisprudence is that the basis for authenticating a hadith is the fairness of the narrator, and his certainty of the narration. The scholars of hadith may narrate the hadith from trustworthy and trustworthy narrators, and then there are reasons that prevent them from ruling on its authenticity.<br/>3- Deep consideration in identifying the differences in texts and chains of transmission is of great importance to the jurist as well as to the hadith scholar.
