Summary, etc.	يُعَدُّ حقُّ التَّأمين الاجتماعيِّ من أهمِّ الحقوق الاجتماعيَّة ذات الآثار الاقتصاديَّة التي استقرَّت في يقين البشريَّة، وهو - بصفةٍ رئيسةٍ - يهُمُّ فئاتٍ أكثر احتياجًا إلى الرِّعايةِ، وهم: (العاجزُون عن الكسب، والأراملُ، والمُسنُّون)؛ لذلك، ينبغي العملُ على النُّهوض بحقِّ التَّأمين الاجتماعيِّ، وهذا النُّهوض يستوجبُ مجموعةً واسعةً من التَّدابير الإداريَّةِ والماليَّةِ والقانونيَّةِ، ويأتي على رأسِ التَّدابير القانونيَّة توفيرُ الحمايَةِ الدُّستوريَّةِ لحقِّ التَّأمين الاجتماعيِّ، والتي تُعدُّ عُنصرًا رئيسًا في هذِه الاستراتيجيَّة. ويُعدُّ الاعترافُ الدُّستوريُّ لحقِّ التَّأمين الاجتماعيِّ بالوثيقة الدُّستوريَّة العُنصرَ الأوَّل من عناصرِ الحمايةِ الدستوريَّةِ له، فأبسطُ ما يدلُّ على وُجود الشَّيء هو الاعترافُ به، وهو ما يجعلُه يتمتَّع بالحماية الدُّستوريَّة، بحيثُ إذا اعتدى المُشرِّعُ على هذا الحقِّ أو انتقصَ منه أو أهدرَهُ فيما يُصدرُه من تشريعاتٍ في نطاقِ سُلطتِه التَّقديريَّة، تكُون هذه السُّلطةُ مَشوبةً بالانحرافِ في استعمالِها، موصومةً بعدمِ الدُّستوريَّة. <br/>وحتَّى تكتملَ عناصرُ الحمايَةِ الدُّستوريَّةِ لحقِّ التَّأمين الاجتماعيِّ، لا بُدَّ من تحقُّق نوعٍ من الرَّقابةِ العُليا على التَّشريعاتِ المُنظِّمة له؛ للتَّحقُّق من عدمِ مُخالفتها لنُصوصِ الدُّستور الأعلى، ويكونُ ذلك عن طريقِ الرَّقابةِ على دستوريَّةِ القوانين، لما تملكُه هذه الرَّقابةُ من سُلطةِ توقيعِ جزاءٍ، له طبيعةٌ خاصَّةٌ، يتمثَّل في القضاء بعدمِ دستوريَّةِ النَّصِّ المُخالف للدُّستور، وبما يترتَّب على ذلك من جبرِ المُخالفةِ الدُّستوريَّةِ، واستبعاد النَّصِّ المقضيِّ بعدم دستوريَّتِه من المنظومةِ القانونيَّةِ.

Summary, etc.	Right to social insurance is considered one of the most important social rights with economic implications that have settled in the consciousness of humanity. It primarily concerns categories in greater need of care, namely: those unable to earn, widows, and the elderly. Therefore, efforts should be made to promote the right to social insurance. This promotion requires a wide range of administrative, financial, and legal measures, with the foremost legal measure being the provision of constitutional protection for the right to social insurance, which is considered a fundamental element in this strategy. The constitutional recognition of the right to social insurance in the constitutional document is the first element of its constitutional protection. The simplest indication of the existence of a thing is its recognition, which entitles it to constitutional protection. Therefore, if the legislator violates this right, diminishes it, or squanders it in its legislation within the scope of its discretionary power, this authority is tainted by the deviation in its use and branded as unconstitutional. In order to complete the constitutional protection elements of the right to social insurance, there must be a kind of supreme oversight of the legislation regulating it to ensure that it does not violate the provisions of the supreme constitution. This is done through the oversight of the constitutionality of laws, as this oversight possesses the authority to impose penalties of a special nature and it has the authority to rule on the unconstitutionality of the text that violates the constitution. This entails rectifying the constitutional violation and excluding the provision ruled as unconstitutional from the legal system.
