| Summary, etc. | يهدف البحث إلى توضيح المراحل الزمنية لاعتباري النظام والعدالة والوقوف على العلاقة ما بين الاعتبارين؛ ليس فقط من الناحية الفلسفية والنظرية، بل ومن الناحية التطبيقية في الواقع. وقد تعرض البحث لمفهوم اعتباري النظام والعدالة، والدور المسيطر في كل مرحلة منهما، والقضايا التي طرح فيها الاعتبارين. والبحث القانوني والقضائي بحث تجريبي لا يعتمد فقط على النصوص القانونية في قوالبها الجامدة، بل يستمد معاييره من التجربة والسوابق القضائية، ولذلك يستهدف البحث بيان المغالطات المنطقية التي قد يقع فيها المهتمين بالبحث القانوني عند تناول أو بحث مسألة قانونية معينة، كما يهدف البحث إلى كشف الحيل التي قد يلجأ إليها الفكر القانوني في الواقع العملي وأمام القضاء لكسب حق معين دون وجه حق، وكذلك الحيل التي قد يستخدمها الدفاع لتفويت الحق على الخصم، وبيان المغالطات التي من الممكن الوقوع فيها في مرحلتي النظام والعدالة، مع تطبيقات على هذه المغالطات في اطار العلاقة بين اعتباري النظام والعدالة، وتناول البحث كيفية مواجهة هذه الحيل في العديد من التطبيقات والنماذج في كافة فروع القانون، ومنها: تطبيقات على قانون حماية المنافسة، وقانون التجارة البحرية، وقانون التأمين الاجتماعي، وقانون العمل، والقانون الجنائي، والقانون المدني، والقانون العام إلخ... وفي التطبيقات العملية والحالات الواقعية، وما قد تبرزه من عوامل تهدد النظام والاستقرار وتنافي العدالة، تناول البحث الكثير من التطبيقات القضائية على نماذج ونظم قانونية، منها قاعدة الشكلية، وقاعدة عدم جواز الاعتذار الجهل بالقانون، وقاعدة التقادم. |

| Summary, etc. | the purpose of this research is to clarify the temporal stages of the consideration of the Regularity or stability and justice, as well as the relationship between these two concepts - not only from a philosophical and theoretical perspective, but also from a practical standpoint. the research addressed the concept of the considerations of the Regularity or stability and justice, the dominant role in each of their stages, and the issues in which these two considerations were raised. The research also aimed to elucidate the logical fallacies that the researcher, the judge, or the legislator may fall into when dealing with the legal text, while distinguishing between the text and the rule. One of the objectives of the research was to clarify the necessary controls to achieve the consideration of the Regularity or stability and justice together without sacrificing either one. In the applied presentation, the research addressed the tricks that litigants and the defense resort to evade certain legal texts, and how to confront these tricks.
