Under international law, the enjoyment of human rights is, in most cases, not attached to holding a specific nationality. Despite this gradual ‘denationalization’ of human rights, nationality still appears to be crucial for the actual enjoyment of human rights and the access to protection mechanisms in case of rights violations .<br/>Not having a nationality – being stateless – may easily push a person into the margins of society, exposing her/him to poverty, exclusion, and all sorts of human rights violations. And even in the absence of such grave consequences, statelessness may still cause numerous difficulties at all spheres of everyday life.<br/>The definition of a stateless person in international law reads as “a person who is not considered as a national by any State under the operation of its law”. There is broad consensus that statelessness must be avoided, a principle confirmed by a large set of international treaties and recommendations. Safeguards are particularly strong in case of new-born children, yet they are far from fulfilling their objective in day-to-day practice.<br/>This truth was acknowledged by Hannah Arendt after World War II, and she coined the phrase "paradox of human rights" to describe how universal human rights fall short for those who most need them. Since they lacked any type of governmental protection, this specialist after her all researchers, she had many conclusion such as the large number of refugees that are fled after the war, a very high percentage of them were stateless.<br/>After many years, there has been a considerable expansion of the international justice system and the human rights movement, and almost all countries on earth now acknowledge the fundamental principles of human rights.<br/><br/><br/> This thesis aims to identify if these contemporary laws, which Arendt attacked in 1951 for failing to guarantee all people's fundamental rights, genuinely serve this purpose today? As well, it aims to identify the legal reasons which expose the children of Syrian refugees born in exile to statelessness.<br/>The current refugee problem is the worst since Arendt's time when her ideas were first formed. Since 2011, the Syrian civil war has caused that millions of Syrians were forced to flee their country. This situation has left a new generation of Syrian children at risk of statelessness. Statistics show in the context of Syrian refugees, not all children are profiting from the legal safeguards.<br/>To address this burning issue, both the international and regional legal frameworks will be analyzed in each article addressing nationality right. As well, nationality laws of two countries (Turkey as European country outside EU and Germany as one of the biggest EU counties) are analyzed and compared. Three essential aspects that are considered within the comparative study are <br/>1) National legal safeguards relating to preclusion of childhood statelessness at birth. <br/>2) The international standards adopted by country.<br/>3) Examples from real practice of the state towards Syrian refugee children.<br/>Based on the research some general recommendations are addressed at the end of the thesis. |

إن عدم الحصول على جنسية، قد يدفع الشخص بسهولة إلى هامش المجتمع، مما يعرضه للفقر والإقصاء وجميع أنواع انتهاكات حقوق الإنسان. <br/>تعريف الشخص عديم الجنسية في القانون الدولي هو "الشخص الذي لا تعتبره أي دولة مواطناً بموجب قانونها". هناك إجماع واسع النطاق على ضرورة تجنب حالات انعدام الجنسية، وهو مبدأ أكدته مجموعة كبيرة من المعاهدات والتوصيات الدولية. وتكون الضمانات قوية بشكل خاص في حالة الأطفال حديثي الولادة، ولكنها بعيدة كل البعد عن تحقيق هدفها في الممارسة اليومية.<br/>وقد اعترفت هاناه أرندت بهذه الحقيقة بعد الحرب العالمية الثانية، وصاغت عبارة "مفارقة حقوق الإنسان" لوصف كيف أن حقوق الإنسان العالمية لا تلبي احتياجات أولئك الذين هم في أمس الحاجة إليها. وبنت الباحثة هانا ارندت استنتاجتها من أبحاثها التي اجرتها على العدد الكبير من اللاجئين الذين فروا بعد الحرب العالمية الثانية ، وكانت نسبة عالية جدًا منهم عديمي الجنسية، حيث وجدت العديد منهم يفتقر إلى حماية الحكومات و الدول الجديدة التي ذهبوا إليها بعد الحرب.<br/>وبعد سنوات عديدة، حدث توسع كبير في نظام العدالة الدولي وحركة حقوق الإنسان، وأصبحت جميع دول العالم تقريباً تعترف الآن بالمبادئ الأساسية لحقوق الإنسان. وتهدف هذه الرسالة البحثية إلى تحديد ما إذا كانت هذه القوانين المعاصرة، التي هاجمتها أرندت عام 1951 لفشلها في ضمان الحقوق الأساسية لجميع الناس، تخدم حقًا هذا الغرض اليوم؟ كما تهدف إلى التعرف على أهم الاليات القانونية على المستويات الثلاث ( الدولية – الاقليمية – المحلية) التي تساهم في الحد من تعرض أطفال اللاجئين السوريين المولودين في المنفى إلى انعدام الجنسية. <br/>إن مشكلة اللاجئين في الفترة من 2011 ل 2016 هي الأسوأ منذ زمن أرندت عندما تشكلت أفكارها لأول مرة. منذ عام 2011، تسببت الحرب الأهلية السورية في اضطرار ملايين السوريين إلى الفرار من بلادهم. وقد ترك هذا الوضع جيلاً جديداً من الأطفال السوريين عرضة لخطر انعدام الجنسية. تظهر الإحصاءات أنه في سياق اللاجئين السوريين، لا يستفيد جميع الأطفال من الضمانات القانونية.<br/>ولمعالجة هذه القضية المُلحة، سيتم تحليل الأطر القانونية الدولية والإقليمية في كل مادة تتناول حق الجنسية. بالإضافة إلى ذلك، يتم تحليل ومقارنة قوانين الجنسية لبلدين (تركيا كدولة أوروبية خارج الاتحاد الأوروبي وألمانيا كواحدة من أكبر دول الاتحاد الأوروبي). |
