Summary, etc.	يعتبر موضوع الشركات المتخصصة في مجال التجارة الإلكترونية من الموضوعات المهمة والحديثة نسبياً في عالم التجارة، نظراً لاجتياح التجارة الإلكترونية العالم بأكمله، وانتشار المواقع والمتاجر الإلكترونية المتخصصة في شتى المجالات التجارية، واتجاه الشركات إلى التعامل في النطاق الإلكتروني، لاسيما الشركات العملاقة منها، حيث برزت أهمية أنشطتها من خلال ما تحققه من أرباح بشكل مضاعف مقارنة بالشركات التقليدية، مما جعلها تشكل محوراً أساسياً في دعم الاقتصاد، والنهوض بالتجارة على المستوى المحلي والدولي. لذلك سعت الباحثة لتوضيح ماهية الشركات المتخصصة في المعاملات التجارية الإلكترونية، لاسيما الشركة التجارية الإلكترونية على اعتبارها المثال الأدق والأوسع للشركات المتخصصة في المعاملات التجارية الإلكترونية، حيث تقوم الشركة التجارية الإلكترونية على الشبكة العنكبوتية وتمارس أنشطتها من خلال الموقع الإلكتروني الخاص بها، كما تتمتع بعدة مزايا تدفع المؤسسين إلى تأسيسها بهٰذا الشكل، وتدفع العملاء للتعامل معها، وفي المقابل تتعرض الشركة التجارية الإلكترونية إلى العديد من المخاطر والمعوقات التي تعيق وجودها، حيث تؤسس بطريقة إلكترونية بدءاً من إبرام عقد التأسيس، ومروراً بإجراءات التأسيس الأخرى، وصولاً إلى تقديم الحصص والشهر دون الحاجة إلى الوجود المادي للأطراف، ويفرض عليها التزامات عدة من قبل الدولة، يتم تنفيذها بواسطة الوسائل الإلكترونية. ونظراً لوجود الفراغ التشريعي في القانون السوري، وعدم تنظيمه لهٰذا النوع من الشركات، وعدم النص على إمكانية تأسيس هٰذه الشركات إلكترونياً وبالإضافة لعدم تطبيق الإصلاحات ذات الدور الأساسي في فرض الالتزامات على هٰذه الشركات، مما جعل هٰذا الفراغ يمثل مشكلة حادة، لها آثار قانونية واقتصادية كبيرة لا بد من معالجتها من خلال اتباع المنهج التحليلي المقارن، للوصول إلى النتائج والحلول التي تساهم في تكوين القواعد القانونية القابلة للتطبيق على هذه الشركات وتشجيع المشرع على الأخذ بها لمواكبة الحداثة والتطوير وسد الفراغ التشريعي الذي يشوب القانون السوري.

Summary, etc.	The topic of companies specialized in e-commerce is a significant and relatively modern subject in the world of trade, particularly given the widespread adoption of e-commerce globally and the proliferation of specialized websites and online stores across various commercial fields. Companies, especially large ones, are increasingly engaging in electronic transactions, demonstrating the importance of their activities through the substantial profits they generate compared to traditional companies. This has made e-commerce a central pillar in supporting the economy and advancing trade at both local and international levels. Therefore, the researcher sought to clarify the nature of companies specializing in electronic commercial transactions, particularly the electronic commercial company, as it represents the most accurate and comprehensive example of such entities. An electronic commercial company operates on the internet and conducts its activities through its dedicated website. It enjoys several advantages that motivate founders to establish it in this manner and encourage customers to engage with it. Conversely, electronic commercial companies face numerous risks and obstacles that hinder their existence. These companies are founded electronically, starting from the establishment contract, through other incorporation procedures, and culminating in the provision of shares and registration without the need for the physical presence of the parties involved. They are also subjected to various obligations imposed by the state, executed through electronic means. Given the legislative vacuum in Syrian law regarding the regulation of such companies and the lack of provisions allowing for their electronic establishment, as well as the absence of reforms essential for enforcing obligations on these entities, this gap poses a significant legal and economic challenge that must be addressed. This can be achieved by adopting a comparative analytical approach to reach findings and solutions that contribute to establishing applicable legal frameworks for these companies, thereby encouraging lawmakers to adopt these measures to keep pace with modernity and development and to close the legislative gap affecting Syrian law.
