Summary, etc.	لم تعد معظم الدول المعاصرة هي تلك الدول الاستبدادية التي يختلط فيها القانون بإرادة الحاكم ومشيئته، دون أن تخضع هذه الإرادة أو المشيئة لقيود محددة معلومة، فغالبية الدول المعاصرة دولة قانونية، تحكمها قاعدة خضوع الحاكم للقانون والتزامه حكمه في كل ما يقوم بين الدولة والمحكومين من علاقات . غير أن هذه الدولة القانونية لم تنشأ فجأة ولكنها جاءت وليدة تطور تاريخي طويل، والدفع منذ أوائل القرن العشرين لدعم فكرة الدولة القانونية بكل ما تقوم عليه من تأكيد خضوع سلطة الحكم لمبدأ سيادة القانون ، أو مبدأ خضوع الدولة للقانون والذي أصبح لا يزال يمثل الضمانة الحقيقية ضد الاستبداد والتعسف. ولفهم الدولة القانونية بصورة واضحة يجب أن نفصل بين حق السلطة السياسية وأشخاص الحاكم ، ذلك لأن الفصل بين حق السلطة وأشخاص الحاكم قد أدى بالضرورة إلى وجود نظام قانوني سابق على هؤلاء الحكام وخارج عن إرادتهم ، يحدد طريقة وصولهم إلى الحكم، وبين مواد اختصاصهم وحدود هذه الاختصاصات ، وهذا النظام القانوني وهو يتكون على هذه الصورة من مجموعة قواعد قانونية ملزمة يعرف بالدستور أو النظام الأساسي لنظام الحكم، وذلك بتحديد الاتجاهات السياسية والاجتماعية والاقتصادية العامة التي يجب أن تعيش في ظلها جميع أوجه النشاط الفردي والحكومي على السواء. وحتى تكون لأحكام الدستور السيادة وحماية لها من الخروج عليها من جانب السلطة التشريعية بما تصدره من تشريعات ؛ قد تنطوي في بعض الاحيان على تعارض مع القواعد الدستورية ، فإن النظم الدستورية الحديثة تحرص على توفير وكفالة نوع من الرقابة على العمل التشريعي الذي تسنه سلطة التشريع وذلك صونا لأحكام الدستور تسمى بالرقابة الدستورية على القوانين.

Summary, etc.	Most contemporary states are no longer those authoritarian states in which the law is mixed with the will and desire of the ruler, without this will or desire being subject to specific known restrictions. <br/>The majority of contemporary states are legal states, governed by the rule of the ruler’s submission to the law and his commitment to its rule in all relations between the state and the ruled. However, this legal state did not arise suddenly, but rather came as a result of a long historical development, and the push since the early twentieth century to support the idea of the legal state with all that it is based on in terms of affirming the submission of the ruling authority to the principle of the rule of law, or the principle of the state’s submission to the law, which has become and continues to represent the real guarantee against tyranny and arbitrariness. To understand the legal state clearly, we must separate the right of political authority from the persons of the ruler, because the separation between the right of authority and the persons of the ruler has necessarily led to the existence of a legal system prior to these rulers and beyond their will, which determines the method of their access to power, and between the articles of their jurisdiction and the limits of these jurisdictions, and this legal system, which consists in this form of a set of binding legal rules, is known as the constitution or the basic law of the system of government, by determining the general political, social and economic trends under which all aspects of individual and governmental activity alike must live. In order for the provisions of the constitution to have sovereignty and to protect them from deviation from them by the legislative authority through the legislation it issues; which may sometimes involve a conflict with the constitutional rules, modern constitutional systems are keen to provide and guarantee a type of oversight of the legislative work enacted by the legislative authority in order to protect the provisions of the constitution, which is called constitutional oversight of laws.
