Summary, etc.	إن مواجهة الإرهاب تستهدف غاية أساسية هي القضاء على ظاهرة الإرهاب، أو الحد من هذه الظاهرة على أدنى تقدير، وهذه المواجهة قد تكون بصورة مباشرة من خلال تجريم الأعمال الإرهابية، والتحري عنها ومرتكبيها، وضبطهم، والتحقيق معهم، ومحاكمتهم، وإنزال عقوبات بهم، وتنفيذ هذه العقوبات عليهم، وقد تكون بصورة غير مباشرة من خلال منع الإرهاب قبل وقوعه بتجفيف منابع تمويله، وإزالة أسبابه وبواعثه، والحدِّ من آثاره بعد وقوعه. وثمة عديد من الصور لمواجهة جرائم الإرهاب أبرزها المواجهة القانونية، وأداة هذه المواجهة هي النظام القانوني لمواجهة جرائم الإرهاب الذي ينصرف مدلوله إلى مجموعة القواعد القانونية المرتبطة ببعضها البعض ارتباطًا وظيفيًا وتعمل مجتمعة على مواجهة جرائم الإرهاب. ولا يمكن تحقيق المواجهة القانونية الشاملة لجرائم الإرهاب في أي نظام قانوني، دولي أو وطني، إلا من خلال العمل على مواجهة جرائم الإرهاب مواجهة قانونية من خلال محاور عدة، يمكن حصرها في خمسة محاور هي: منع الإرهاب، تجريم الإرهاب والعقاب عليه، التنظيم الإجرائي لمواجهة الإرهاب، إعادة تأهيل الإرهابيين وإدماجهم في المجتمع، تنظيم حقوق ضحايا الإرهاب. بيد أن النظم القانونية الدولية والوطنية وإن تعرضت للمحاور الخمسة للمواجهة القانونية للإرهاب، بيد أنها لم تعن بالمحاور جميعها بالقدر ذاته، وإنما تباينت في اهتماماتها، فتعرضت لبعضها بمزيد من التفصل، وتعرضت للبعض الآخر بقدر من التحفظ. وفي ضوء أن العلاقة بين الإرهاب وحقوق الإنسان هي علاقة متداخلة، يشوبها كثيرٌ مظاهر التعقيد، وكلاهما ضروريان لوجود الدولة ذاتها، فلا وجود للدولة إذا لم تعمل على مواجهة الإرهاب الذي يهدد هذا الوجود، ولا وجود لدولة القانون في غياب احترام حقوق الإنسان، ولو كان انتهاكها بدافع من اعتبارات مواجهة للإرهاب، ولكن في الوقت ذاته لا يمكن مواجهة الإرهاب ــ شأنه شأن أي ظاهرة إجرامية أخرى ــ دون فرض بعض القيود على الحقوق والحريات. وهو ما يوجب على المشرع الوطني لدى صياغة نظام قانوني لمواجهة جرائم الإرهاب أن يحقق التوازن الدقيق والصعب بين التزام الدولة بمواجهة الإرهاب من ناحية، والتزامها باحترام حقوق الإنسان من ناحية أخرى.

Summary, etc.	The main aim of countering terrorism is to eliminate the phenomenon of terrorism, or to reduce it. As such, it can be countered directly through the criminalization of terrorist acts in legislation, investigation of terrorist acts, seizure their perpetrators, investigation and prosecution, trials and the punishment of defendants found guilty. Also, this countering can be indirectly through preventing terrorism before it occurs by drying up the sources of its financing, eliminating the causes and motives of terrorism, and limiting its effects after it occurs. There are many ways of countering terrorist crimes, the most prominent of which is the legal countering, and the instrument of this countering is the legal regime to deal with terrorist crimes, which refers to the set of legal rules that are functionally related to each other and work together to counter terrorist crimes. A comprehensive legal response to terrorist crimes in any international or national legal regime can be achieved only by countering terrorist crimes in a legal manner through several axes, which can be crystallized into five axes: the prevention of terrorism; the criminalization and punishment of terrorism; the procedural regulation of counter terrorism; the rehabilitation and social reintegration of terrorists; and the protection of the rights of victims of terrorism. However, international and national legal regimes have not given same diligence to these five axes; they have not all dealt with these aspects, some legal regimes dealt with these axes in details and others in a minimal details, this according to the private interests of each legal regime. <br/>Given that the very complex and intertwined relationship between terrorism and human rights, both of them are essential to the existence of the State. There is not an existence of a State without countering terrorism that threatens this existence, moreover, there is no State of law without the protection of human rights, even if the violation of these rights is motivated by the considerations of countering terrorism. At the same time, terrorism – like any other criminal phenomenon – cannot be tackled without some restrictions on rights and freedoms. In formulating a legal regime to deal with terrorist crimes, the national legislature, must strike a delicate and difficult balance between the State's commitment to counter terrorism, on the one hand, and its commitment to respect human rights on the other.
