Summary, etc.	الرساله هي مستودع أسرار وخصوصيات الإنسان فهى امتداد لحرية الفكر وتعد حرية سرية المراسلات من أهم الحقوق الجوهرية الملاصقة للحياة الخاصة وتطورت هذه الحرية بنشأة وسائل المراسلات الالكترونية كالبريد الالكتروني وشبكات التواصل الاجتماعي والهواتف الخلوية وتبدو إشكالية الحدود بين بين ممارسة هذه الحرية وحدود سلطات الضبط الاداري في الرقابة عليها أمر في غاية الأهمية وقد تناولنا في هذه الدراسة بعض الأمور الهامة التي تتعلق ببيان ماهية حرية سرية المراسلات الإلكترونية ووسائل ممارستها ثم تعرضنا إلى التنظيم التشريعي لهذه الحرية والحقوق المتعلقة بها ثم بيان ماهية ما يعرف بالضبط الاداري بإستخدام وسائل الكترونية والمخاطر الناجمة عن إستخدام المراسلات الإلكترونية التي تهدد النظام العام كما عرضنا للرقابة القضائية على سلطات الضبط الاداري وضروره التزامها بقواعد المشروعية وموقف القضاء الدستوري والمستعجل والادارى في الرقابه على هذه السلطات وتطبيقات هذه الرقابة في كل من مصر وفرنسا وبينا جزاء المسؤولية عن تجاوز سلطات الضبط الاداري حيال ممارسة هذه الحرية وذلك ببيان ماهية المسؤولية الادارية والزام سلطات الضبط بتعويض المضرورين حال الاعتداء على هذه الحرية والتي لا يتقادم الاعتداء عليها بمضي المدة وأخيرًا عرض الباحث لأهم النتائج التي توصَّل إليها بصدد البحث في حدود سلطات الضبط حيال حرية سرية المراسلات الإلكترونية والتوصيات المقترحة ومنها مشروع قانون لحماية حرية سرية المراسلات الإلكترونية .

Summary, etc.	The message is a repository of human secrets and privacy, it is an extension of freedom of thought and the freedom of confidentiality of correspondence is one of the most important fundamental rights adjacent to private life and the evolution of this freedom with the emergence of electronic correspondence means such as e-mail, social networks and cellular phones and it seems problematic boundaries between the exercise of this freedom and the limits of the powers of administrative control in control of it is very important and we have dealt in this study with some important matters related to the statement of what is the freedom of confidentiality of electronic correspondence and the means of practicing it and then we were exposed To the legislative regulation of this freedom and the rights related to it and then a statement of what is known as administrative control using electronic means and the risks resulting from the use of electronic communications that threaten public order as we presented the judicial control over the administrative control authorities and the need to adhere to the rules of legality and the position of the constitutional, urgent and administrative judiciary in controlling these authorities and the applications of this control in both Egypt and France and we showed the penalty of responsibility for exceeding the administrative control authorities regarding the exercise of this freedom by indicating the nature of administrative responsibility And oblige the control authorities To compensate the injured persons in the event of an assault on this freedom, which is not time-barred by the lapse of time. Finally, the researcher presented the most important findings regarding the research within the limits of the control authorities regarding the freedom of confidentiality of electronic correspondence and the proposed recommendations, including a draft law to protect the freedom of confidentiality of electronic correspondence.
