| Summary, etc. | عد التحكيم من اهم الوسائل البديلة لحل منازعات عقود جولات التراخيص النفطية، فهو شرط أساسي في نماذج عقود شركات البترول العالمية، والضامن لحماية استثماراتها في الدول المنتجة ، لما تتمتع به عقود التراخيص من أهمية اقتصادية من ناحية، وخصوصية إدارية من ناحية أخرى تتمثل بوجود الدولة او احد مؤسساتها طرفا في تلك العقود، مما يؤدي بالنتيجة إلى المشاركة في الإجراءات بشكل يضمن المساواة بين اطراف العقد، ولأن الدافع الرئيسي للدول المتعاقدة والمشترطة للتحكيم في العقد، هو مراعاة المصالح العليا المرتبطة بهذه العقود، والمدعاة الأساسية للتعاقد المتضمنة الحاجة إلى رؤوس الأموال الأجنبية أو للتقنية المتطورة التي تملكها الشركات الأجنبية المتعاقدة والعاملة في القطاع النفطي، وان ما يدفع تلك الشركات الى أشتراط التحكيم هو لحماية استثماراتها من استغلال الدولة لسلطتها وتحكمها في الغالب بالقضاء الوطني ، ومن المعروف ان كل دراسة لها ميزه وطريقة خاصة بها، لذا اعتمدت هذه الدراسة على المنهج التحليل الوصفي والمقارن لإظهار واقع القانوني العراقي والتشريعات المقارنة وموقف فقهاء القانون من التحكيم ومدى أهميته وفعاليته في عقود التراخيص النفطية. |

| Summary, etc. | Arbitration is one of the most important alternative means of resolving oil licensing contract disputes.It is a prerequisite in the models of international petroleum companies' contracts and a guarantor of protecting their investments in producing countries. The economic significance of licensing contracts, on the one hand, and the administrative specificity of the State or one of its institutions being a party to such contracts, on the other, The result is participation in the proceedings in a manner that ensures the equality of the parties to the contract, and that the Contracting and Requisitioning States' main motive for arbitration in the contract is to take into account the higher interests associated with these contracts, and the underlying reason for contracting the need for foreign capital or sophisticated technology owned by foreign companies. Contracting and operating in the oil sector, and what prompts these companies to require arbitration is to protect their investments from the State's abuse of power and control over the national judiciary. Each study is known to have its own advantage and method, so this study relied on a descriptive and comparative analysis approach to demonstrate the realities of Iraqi law and comparative legislation.
