| Summary, etc. | شهدت العقود الأخيرة تحولًا كبيرًا في طبيعة النزاعات المسلحة عالميًا، حيث أصبحت النزاعات غير الدولية التي تشارك فيها كيانات مسلحة من غير الدول هي السائدة، في حين أصبحت الحروب التقليدية بين الدول استثناء. وقد أثار هذا التحول تساؤلات قانونية بشأن مسؤولية هذه الكيانات عن انتهاكات حقوق الإنسان والقانون الدولي الإنساني. ورغم أن القانون الدولي التقليدي يركز على الدول والمنظمات الدولية كأشخاص رئيسيين، فإنه يظل يتجاهل دور الفاعلين غير الدوليين مثل الكيانات المسلحة. تهدف هذه الدراسة إلى معالجة هذه الفجوات القانونية من خلال اقتراح إطار قانوني يضمن محاسبة هذه الكيانات بشكل جماعي.تعتمد الدراسة على المنهج الوصفي التحليلي، حيث يتم تحليل النصوص القانونية ذات الصلة، ومراجعة الاجتهادات القضائية والفقهية، وتقديم مقترحات لتطوير آليات المحاسبة القانونية لهذه الكيانات. تركز الدراسة على التحديات التي تواجه محاسبة الكيانات المسلحة ككيانات جماعية بدلًا من محاسبة الأفراد فقط، مشيرة إلى ضرورة تطوير إطار قانوني جديد يتيح محاسبة هذه الكيانات بشكل فعال، بما في ذلك إنشاء محكمة دولية خاصة بها أو تعديل القواعد القانونية الدولية الحالية لتشملها. وتؤكد الدراسة على أهمية العدالة الجماعية لهذه الكيانات لضمان ردع الجرائم وتحقيق العدالة الدولية. |

| Summary, etc. | In recent decades, there has been a significant shift in the nature of armed conflicts globally, where non-international conflicts involving non-state armed entities have become predominant, while traditional inter-state wars have become the exception. This shift has raised legal questions regarding the responsibility of these entities for violations of human rights and international humanitarian law. Although traditional international law focuses on states and international organizations as key actors, it still neglects the role of non-state actors, such as armed entities. This study aims to address these legal gaps by proposing a legal framework that ensures the collective accountability of these entities.The study adopts a descriptive-analytical approach, analyzing relevant legal texts, reviewing judicial and scholarly opinions, and offering proposals for developing legal accountability mechanisms for these entities. The study focuses on the challenges of holding non-state armed entities accountable as collective bodies rather than merely holding individuals accountable, highlighting the need for a new legal framework that enables effective accountability of these entities. This includes establishing a special international court for them or adapting existing international legal rules to include them. The study emphasizes the importance of collective justice for these entities to ensure the deterrence of crimes and the achievement of international justice. |
