| Summary, etc. | لقد جاءت الرسالة في أربعة فصول، وعدة مباحث، ومطالب، وفروع، وأغصان، وقد كانت الدراسة حول الحكم الفقهي، والقانوني لموضوع الآثار، وما يتعلق بها من أمور، وما يرتبط بها من أحكام، فقد ألقت الدراسة الضوء على حكم التنقيب على الآثار في الفقه الإسلامي واختلف الحكم ما بين مؤيدٍ ومعارض، كما تناولت الدراسة حكم ترميم الآثار، وتعرضت لما استند له الرأي القائل بهدم الآثار وعدم ترميمها، كما تعرضت الدراسة لحكم التجارة في الآثار من قِبَل الأشخاص، بعد أن بيَّنت الدراسة أن الآثار تعدُّ من قبيل الأموال العامة، وقد جاءت الآيات القرآنية تحرم الأخذ والغلول من الأموال العامة، وبيَّنت السنة المطهرة هذا أيضًا في أكثر من حديثٍ نبويٍّ شريفٍ، فيحرم الاتجار في الأموال العامة، كما بينت الدراسة أحكام السرقة وأركانها وشروطها، ثم تناولت تهريب الآثار بين الفقه الإسلامي والقانوني الوضعي، وتعرضت الدراسة لحكم إتلاف الآثار في الفقهي الإسلامي، وأخيرًا كان الحديث عن الحماية الجنائية دوليًّا ومحليًّا للآثار والممتلكات الثقافية، وطرق استرداد الآثار المهربة داخليًا أو خارجيًا.<br/><br/> |

The study was about the jurisprudential and legal ruling on the subject of antiquities, and the matters related to them, and the rulings related to them. The study shed light on the ruling on excavating antiquities in jurisprudence. The ruling differed between supporters and opponents. The study also dealt with the ruling on restoring antiquities, and examined what the opinion based on was demolishing antiquities and not restoring them, The study also addressed the ruling on trading in antiquities by people, after the study showed that antiquities are considered public funds, and Qur’anic verses prohibit taking and exploiting public funds, and the Sunnah also clarified this in more than one noble prophetic hadith, so trading in funds is forbidden. <br/><br/> |
