| Summary, etc. | يهدف هذا البحث إلى تطبيق منهج التحليل الاقتصادي على أحكام كسب الملك في الفقه الإسلامي، وذلك من خلال استكشاف مدى إمكانية الاستفادة من هذا التحليل في فهم وتطوير الأحكام الفقهية ذات الصلة. يستعرض البحث مدرسة التحليل الاقتصادي للقانون، التي تركز على دراسة تأثير القوانين على السلوك الاقتصادي للأفراد والمجتمعات، ويبحث في إمكانية توظيف هذه المنهجية في دراسة الأحكام الفقهية الإسلامية دون الإخلال بمقاصد الشريعة. كما يتناول البحث مفهوم الملكية في الإسلام، وأسباب كسبها المشروعة وغير المشروعة، وتأثيرها الاقتصادي، مع مقاربة تحليلية تقارن بين النظرية الفقهية والمفاهيم الاقتصادية الحديثة. تعتمد الدراسة على المنهج الوصفي والتحليلي، حيث يتم تحليل النصوص الفقهية في ضوء المبادئ الاقتصادية بهدف استنباط العلاقة بين الأحكام الفقهية والكفاءة الاقتصادية. توصل البحث إلى أن الفقه الإسلامي يتمتع بمرونة كافية تسمح بإخضاع أحكامه للتحليل الاقتصادي، مما يسهم في فهم أعمق لكيفية تحقيق مقاصد الشريعة الإسلامية في مجال المعاملات المالية والملكية |

| Summary, etc. | This research aims to apply the economic analysis methodology to the rulings on property acquisition in Islamic jurisprudence, exploring the potential benefits of this approach in understanding and developing relevant legal rulings. The study examines the school of economic analysis of law, which focuses on assessing the impact of legal rules on individual and societal economic behavior, and investigates the feasibility of integrating this methodology within Islamic jurisprudence without compromising the objectives of Sharia. The research also explores the concept of ownership in Islam, its legitimate and illegitimate means of acquisition, and its economic implications, employing an analytical approach that compares Islamic legal theory with modern economic concepts. The study adopts a descriptive and analytical methodology, analyzing Islamic legal texts in light of economic principles to uncover the relationship between jurisprudential rulings and economic efficiency. The research concludes that Islamic jurisprudence is sufficiently flexible to undergo economic analysis, providing a deeper understanding of how Sharia objectives can be achieved in financial transactions and property ownership. |
