| Summary, etc. | تهدف هذه الدراسة إلى التعرف على سياسات التجريم والعقاب فيما يتعلق بالأفعال التي تمس أمن الدولة. من خلال دراسة مقارنة، يركز البحث على أهمية الدولة وكيانها، حيث تشكل الانتهاكات ضدها مخاطر وخطورة جسيمة. لقد وضع المنهج الوضعي قواعد محددة لحماية الدولة، بهدف ضمان الاستقرار المجتمعي والحفاظ على عناصره الأساسية، وبالتالي منع الفاسدين وغير القانونيين من العبث بها.تقتضي السياسة الجنائية، بغض النظر عن المكان والزمان، تجريم الأفعال التي تضر بالمصالح المجتمعية والفردية، إلى جانب وضع العقوبات المناسبة. بدون إطار التجريم والعقاب هذا، لا يمكن للمجتمع أن يحقق الاستقرار والتنمية. بالإضافة إلى ذلك، تتطلب العدالة الجنائية الاعتراف بالمتهم كإنسان يتمتع بكرامة متأصلة، وعواطف، وهوية، وشخصية. وبالتالي، فإن السعي لتحقيق العدالة يستلزم واجب حماية حقوق الإنسان، وتوفير ضمانات كافية أثناء المحاكمات، وحماية الجوانب الموضوعية للحقوق والحريات، فضلاً عن مختلف الحقوق الإجرائية.من خلال تحليل سياسات التجريم والعقاب في الأعمال التي تمس أمن الدولة، تؤكد هذه الدراسة على أهمية الموازنة بين المصالح المجتمعية وحماية الحقوق الفردية. ويؤكد على ضرورة إقامة نظام قانوني عادل ومنصف يضمن استقرار الدولة، ويصون حقوق الإنسان، ويضمن الحفاظ على الحريات الأساسية. |

| Summary, etc. | This study aims to explore the policies of criminalization and punishment regarding acts that affect the security of the state. Through a comparative study, the research focuses on the significance of the state and its entity, as violations against it pose great dangers and seriousness. The positivist approach has established specific rules to protect the state, aiming to ensure societal stability and preserve its fundamental elements, thereby preventing the corrupt and lawless from tampering with them.Criminal policy, irrespective of place and time, necessitates the criminalization of acts that harm societal and individual interests, along with the establishment of appropriate penalties. Without this criminalization and punishment framework, society cannot attain stability and development. Additionally, criminal justice requires recognizing the accused as a human being, with inherent dignity, emotions, identity, and personality. Consequently, the pursuit of justice entails a duty to safeguard human rights, provide adequate safeguards during trials, and protect both objective aspects of rights and freedoms, as well as various procedural rights.By analyzing the policies of criminalization and punishment in acts affecting state security, this study emphasizes the importance of balancing societal interests with the protection of individual rights. It underscores the need to establish a just and fair legal system that ensures the stability of the state, safeguards human rights, and guarantees the preservation of fundamental freedoms. |
