| Summary, etc. | تتناول هذه الدراسة أحكام البيع، وذلك من خلال قضايا سجلات المحاكم الشرعية المصرية في العصر العثماني، مع تأصيل هذه الأحكام وتحليلها وبيان أسبابها الشرعية والواقعية؛ مع مناقشة تلك الأحكام القضائية التي قررها قضاة المحاكم الشرعية في ذلك العصر الممتد المترامي، ومقارنة تلك الأحكام بما قررته الشريعة الإسلامية والقانون المصري من أحكام في هذا الباب المهم الشاسع؛ وتهدف هذه الدراسة إلى الوقوف على النقاط المركزية والخطوط الفاصلة التي كان يحتكم إليها قضاة المحاكم الشرعية في فصلهم في قضايا البيع بكافة صوره وعناصره، وكذلك الوقوف على ملامح التجديد الفقهي والقضائي في عصر الدولة العثمانية، ومعرفة مدى تأثير الجانب التطبيقي العملي للأحكام الفقهية على الآراء الفقهية الثابتة والمستقرة، ومعرفة مدى تأثير التطور الاجتماعي والاقتصادي في الأحكام الفقهية والقضائية. |

| Summary, etc. | This study deals with the rulings on sale, through the cases of Egyptian Sharia court records in the Ottoman era, rooting and analyzing these rulings and explaining their legal and realistic reasons. With a discussion of those judicial rulings that were decided by Sharia court judges in that extended and vast era, and a comparison of those rulings with the rulings decided by Islamic Sharia and Egyptian law in this vast important section; This study aims to identify the central points and dividing lines that Sharia court judges resorted to in deciding sales cases in all its forms and elements, as well as identifying the features of jurisprudential and judicial innovation in the era of the Ottoman Empire. |
