| Summary, etc. | تتلخص هذه الرسالة فى فصل تمهيدى وبابين، وقد اشتملت على بيان أن المشروعات المتعثرة هى: التى تواجه ظروفا عارضة أثرت فى نتائج أعمالها ، ولكن لديها إمكانيات منتجة يمكن بواسطتها إصلاح مسيرتها ، والنهوض من عثرتها ، إذا توافرت لها السبل الموارد المتاحة.وبينت الرسالة دور التمويل الذى تمثل فى دور الدولة والعاملين والجهاز المصرفى والتمويل من خلال المشاركات ، أو الإيجار ، أو السلم بجانب مسئولية الإدارة عن فشل المشروع ، وقد أثبتت أن القانون المصرى قدم حلولاً عملية فى كل ذلك.ولذا أصبح إنهاض المشروعات المتعثرة من الإفلاس، هو السبيل الوحيد والملاذ الأخير لها، ومن ثم لا يوقف نشاطها، ويترك مصيرها للدائنين، وإنما يجب وضع القواعد الكفيلة واللازمة التي يتسنى بها ضمان استمرار نشاط هذه المشروعات التي يكون هناك ثمة أمل في تقويمها، وبالتالي لا تسري على المشروعات الميئوس من إنقاذها، وإلا أدى ذلك إلى إيجاد ملاذ آمن للمشروعات المتحضرة التي يستحيل إنقاذها.ويأخذ بنظام الإفلاس بمفهومه الحديث على أنه قانون لإنهاض المشروعات المتعثرة التي تتوافر لديها مقومات الإصلاح، حفاظًا على العاملين فيها، وما تؤديه من دور في خطة الدولة، بجانب تحقيقها للمنافع الاجتماعية، سواءً أكانت تجارية أم غير تجارية، خاصة وقد ثبت لنا مدى التقارب الذي حدث بين نظام الإعسار والإفلاس في الوقت الحاضر، ومدى تداخل الحياتين المدنية والتجارية، وغدا التفريق بين كافة الأنشطة أمرًا متعذرًا.<br/>لذلك أصبح شغل شاغل المشرع الفرنسي ومحاولة إنهاض المشروعات المتعثرة من الأزمة التي لحقتها، وإنقاذها من الكبوة التي ألمت بها وضرورة للاعتماد أو الائتمان المؤجل لمدة أقل من سنة، وهو نص خاص بالإنهاض ولا يستفيد منه ضامنوا المدين الخاضع للتقويم القضائي. |

It is no longer tolerable, as it has left clear effects on the national economy, whose performance has increased in confusion and suffering, and bad effects on the climate of saving and investment, reaching every home, whichHe made the President of the Republic intervene personally to find a solution to the problem. He asked the concerned ministers to prepare comparative reports for troubled projects and companies, set goals and increase production and its quality. At the same time, he was keen to meet with the leaders of companies to learn about their views and opinions on reforming financing structures and increasing production.
