| Summary, etc. | تعد سوق الأوراق المالية "البورصة" من أهم القنوات التي يناسب فيها رأس المال من وحدات الإدخار الرئيسية وهم الأفراد والمؤسسات، إلى وحدات الاستثمار وهم الشركات والمشاريع والحكومة، وبالتالي فهي أحد الوسائل الهامة لتعبئة المدخرات على المستوى القومي، وخاصة بالنسبة لدولة نامية مثل مصر، والتي تتميز باتساع الفجوة التمويلية.لذلك كان اهتمام الدولة – في الآونة الأخيرة – بتنظيم أحكام التعامل في بورصة الأوراق المالية بما يتواكب مع تغييرات العصر وحركة تصحيح المسار الاقتصادي والتشريعي للبلاد.لذلك صدر قانون سوق رأس المال رقم 95 لسنة 1992، حيث ألغى القانون رقم 161 الصادر سنة 1975 الخاص باللائحة العامة لبورصة الأوراق المالية، وقد استهدف القانون رقم 95 لسنة 1992 سد الثغرات التي لحقت بتشريعات سوق رأس المال، وتنشيط عمليات البورصة، ووضع الضمانات اللازمة لصحة تعاملات البورصة.وقد صدر قانون التجارة الجديدة رقم 17 لسنة 1999 متضمناً بعض أحكام سوق الأوراق المالية في الفصل السادس من الباب الأول.ثم صدر قانون الإيداع والقيد المركزي للأوراق المالية رقم 93 لسنة 2000، ثم صدرت قرارات وزارة الاقتصاد والتجارة الخارجية أرقام 43، 44، 92، 586 لسنة 2000 بتعديل بعض أحكام اللائحة التنفيذية لقانون سوق رأس المال رقم 95 لسنة 1992 وغيرها من القرارات الأخرى.وقد اهتم المشرع المصري بإنشاء صناديق الاستثمار بموجب قانون سوق رأس المال رقم 95 لسنة 1992، كإحدى صور التوظيف الجماعي للاستثمار في مجال الأوراق المالية. |

| Summary, etc. | The stock market "the stock exchange" is one of the most important channels through which capital is appropriated from the main savings units, which are individuals and institutions, to investment units, which are companies, projects and the government, and therefore it is one of the important means of mobilizing savings at the national level, especially for a developing country like Egypt, which is characterized by a wide financing gap.Therefore, the state has been interested - recently - in organizing the provisions of dealing in the stock exchange in a manner that keeps pace with the changes of the era and the movement to correct the economic and legislative path of the country.Therefore, Capital Market Law No. 95 of 1992 was issued, where it abolished Law No. 161 issued in 1975 regarding the general regulations of the stock exchange. Law No. 95 of 1992 aimed to fill the gaps in the capital market legislation, activate stock exchange operations, and establish the necessary guarantees for the validity of stock exchange transactions.The new Trade Law No. 17 of 1999 was issued, including some provisions of the stock market in Chapter Six of Part One.Then the Central Depository and Registration of Securities Law No. 93 of 2000 was issued, then the Ministry of Economy and Foreign Trade decisions Nos. 43, 44, 92, 586 of 2000 were issued amending some provisions of the executive regulations of the Capital Market Law No. 95 of 1992 and other decisions. The Egyptian legislator was interested in establishing investment funds under the Capital Market Law No. 95 of 1992, as one of the forms of collective investment in the field of securities. |
