| Summary, etc. | بعد حمد لله تبارك وتعالى، والصلاة والسلام على رسوله ﷺ ، فقد عمدتُ من خلال درسي هذا الموضوع، الذي رأيته مهمًا جدًا لتأصيله في النظام السعودي الحالي وما استُجد فيه من مواد، فجاءتني فكرة تناولتُ بها: هل يمكن إقامة الحد بالقرائن، أم أن ذلك قاصر على باب البينات ؟الحقيقية وبعد قراءتي للتراث الفقهي في المسألة، تبيّن لي بجلاء أن القرينة هادية إلى الدليل، وليست دليلَ إثبات يمكن تطبيق الحد اعتمادًا عليه، وعليه فقد قمت بالبرهنة على أن القرينة يَثبت بها ما لا يَثبت بغيرها، لكنها لا تستقل لأن يُقام الحد اعتمادًا عليها |

| Summary, etc. | After praising Allah, the Blessed and Exalted, and sending peace and blessings upon His Messenger ﷺ, I have chosen to address this topic in my lecture, as I found it extremely important to establish its foundations within the current Saudi legal system and its newly introduced provisions. This led me to explore the question: Can prescribed punishments be established based on circumstantial evidence, or is this limited to direct evidence?Upon examining the jurisprudential heritage on the matter, it became clear to me that circumstantial evidence serves as a guide toward proof but does not itself constitute proof sufficient to apply prescribed punishments. |
