| Summary, etc. | تسلط الدراسة الضوء على واحدة من المواقف المعقدة للغاية التي تم تجاهلها إلى حد كبير وهي الصلة بين R2P والجرائم الفظيعة الدائمة داخل الأراضي الفلسطينية المحتلة، وغزة من جولات الحرب المتكررة والحصار، والفصل العنصري المستمر، والاضطهاد والتطهير العرقي. وتسعى هذه الدراسة لبحث إذا كان مبدأ المسؤولية عن الحماية (R2P) ينطبق على النزاع المستمر في غزة وما إذا كان النظر إلى النزاع من خلال إطار المسؤولية عن الحماية مفيداً أو لا؛ فعلى الرغم من ان R2P تنطبق عادة على النزاعات داخل الدولة إلا ان الوضع القانوني لغزة وخضوعها للاحتلال المطول يعقد هذا الأمر. وتوصلت الدراسة الى التشكيك في - حتى اذا صح تطبيق R2p بموجب التفسير الواسع للمادة ١٣٩-، الاحتجاج ب R2P سيحقق أهدافه بحماية المدنيين في هذا الوضع المُسيس للغاية؛ وبشكل خاص في ظل العدوان الإسرائيلي على غزة بعد السابع من أكتوبر ٢٠٢٣ فبالنظر إلى ردود الحكومة الإسرائيلية الرافضة على الانتقادات للطريقة التي شنت بها هجومها في غزة من الأمم المتحدة ، و رد فعلها تجاه المنظمات غير الحكومية للإغاثة والتنمية وحقوق الإنسان؛ يتضح أن مختلف الاستجابات والعقوبات الدولية غير العسكرية المتاحة بموجب المسؤولية عن الحماية لن يكون لها أي تأثير.أما بالنسبة للرد العسكري المسموح به بموجب R2P؛ فلن يتمكن من الوفاء بمعيار الاحتمال المعقول للنجاح الذي يعد أحد أسئلة العتبة الستة التي يجب الإجابة عليها جميعاً بالإيجاب من أجل تبرير التدخل القسري؛ وذلك لأن إسرائيل قوة نووية وحليف قوى عظمى نووية ايضاً، والتدخل المسلح بموجب المسؤولية عن الحماية يعتمد بالأساس على موافقة مجلس الأمن فهي رهن المصالح السياسية للأعضاء الخمسة الدائمين في مجلس الأمن الذين يملكون حق النقض الفيتو؛ وبالتالي ستستخدمه الولايات المتحدة الأمريكية في أي محاولة لتوبيخ إسرائيل. |

It highlights the ambiguity surrounding R2P’s scope, traditionally confined to intra-state wars, and explores whether it can be extended to international armed conflicts where the perpetrator and victims belong to different states. The analysis considers Gaza’s status as part of the State of Palestine and Israel’s de facto occupation despite its 2005 disengagement. The study examines whether R2P’s application can effectively protect civilians and halt atrocities in such conflicts. It reviews precedents like the Libyan intervention, the political dynamics of Security Council decisions, and the inherent challenges in implementing R2P due to political interests and the veto right of permanent members. The findings suggest that R2P, while theoretically applicable, faces significant practical and political barriers, particularly in conflicts involving primary power interests, rendering its utility in Israeli aggression on Gaza limited and highly politicized. |
