يدور موضوع البحث حول أحد الموضوعات المهمة والحيوية جدًا، ألا وهو التصرفات القانونية المتعلقة بعمليات نقل وزراعة الأعضاء البشرية، دراسة مُقَارنَة بين القانون المِصري والقانون الفَرنسي والفقه الإسلامي، مع التعرض لبعض القوانين العربية التي نظمت هذه العمليات منذ عدة عقود للاستفادة بما توصلت إليه من نجاحاتٍ في هذا المجال. وقد تم بحث ودراسة الموضوع عن طريق تقسيمه إلى باب تمهيدي، للحديث عن ماهية هذه العمليات؛ من حيث بيان تعريفها، ونشأتها والتمييز بينها وبين غيرها من العمليات، وتحديد طبيعة التصرف القانوني لنقل وزراعة الأعضاء، من حيث بيان مفهومه، وصوره، وأركانه، ونطاقه. وتلى ذلك الباب الأول، الذي يدور حول صور التصرفات القانونية لنقل وزراعة الأعضاء بين الأحياء، سواء غير المشروعة كالبيع، أو المشروعة كالتبرع، وتحديد ضوابط هذا التصرف المشروع، والتي من بينها رضاء كل من المتبرع والمريض، والضرورة العلاجية وترجيح نجاح العملية، والمحافظة على حرمة المتبرع وكرامته، وحظر اختلاط الأنساب، ثم تم تناول الآثار القانونية الناشئة عن هذا التصرف، كحق المتبرع في العدول عن التبرع، وتعويضه عما أصابه من أضرارٍ وما فاته من كسبٍ جراء التبرع، وغيرها من الآثار. <br/>ثم الباب الثاني، الذي جاء للحديث عن التصرفات القانونية لنقل الأعضاء من الموتى إلى الأحياء، سواء عن طريق الشخص نفسه قبل وفاته بالوصية، أو عن طريق الغير كالأقارب أو الدولة، بحسب الأحوال، وتحديد الموقف الشرعي والقانوني من نقل الأعضاء من جثث المحكوم عليه بالإعدام والأجنة المجهضة، وتم توضيح ضوابط التصرف القانوني لنقل الأعضاء من الجثة عن طريق الوصية، وكذا الآثار الناشئة عن هذا التصرف سواء قبل وفاة الموصي كرجوعه عن الوصية، أو بعد وفاته كتنفيذ الوصية والمحافظة على حرمته وكرامته عند نقل الأعضاء من جثته وغيرها من الآثار.وعقب الانتهاء من بحث ودراسة الموضوع على هذا التقسيم، فقد تم التوصل إلى عدد من النتائج والتوصيات التي يبدو أهميتها في علاج العديد من المشكلات التي تواجه عمليات نقل وزراعة الأعضاء في مصر، كما تم صياغة هذه النتائج والتوصيات في صورة مشروع قانون مقترح وملحق بالرسالة. |

The research topic revolves around one of the very important and vital topics, which is the legal procedures related to the transfer and transplantation of human organs, a comparative study between Egyptian law, French law, and Islamic jurisprudence, with an exposure to some Arab laws that regulated these operations several decades ago to benefit from the successes they have achieved in this field. <br/>The topic was researched and studied by dividing it into an introductory section, to talk about what these operations are; In terms of explaining its definition, its origin, distinguishing between it and other operations, and determining the nature of the legal procedure for organ transplantation and transplantation, in terms of explaining its concept, forms, pillars, and scope.This was followed by the first chapter, which revolves around the forms of legal actions to transfer and transplant organs between living people, whether illegal such as sale, or legitimate such as donation, and defining the controls for this legitimate action, which include the consent of both the donor and the patient, the therapeutic necessity and the likelihood of the success of the operation, and preserving the sanctity of the donor. His dignity, and the prohibition of mixing lineages, then the legal implications arising from this behavior were addressed, such as the donor’s right to withdraw from the donation And compensate him for the damages he suffered and the gains he lost as a result of the donation, and other effects.Then the second chapter, which came to talk about the legal procedures for transferring organs from the dead to the living, whether through the person himself before his death by will, or through others such as relatives or the state, as the case may be, and to determine the legal and legal position on transferring organs from the bodies of those sentenced to death and aborted fetuses. The legal procedures for transferring organs from a corpse through a will were clarified As well as the effects arising from this behavior, whether before the death of the testator, such as his revocation of the will Or after his death, such as executing the will and preserving his sanctity and dignity when transferring organs from his body and other relics.Following the completion of research and study of the issue according to this division, a number of results and recommendations were reached that appear to be important in treating many of the problems facing organ transplantation and transplantation operations in Egypt. These results and recommendations were also formulated in the form of a proposed draft law and an appendix to the letter |
