| Summary, etc. | تأتي هذه الدراسة للتعرف على المسائل الفقهية التي ضُبِطَتْ بالسن، وجمع المسائل وتحريرها بتفصيل القول، وبيان الراجح من الآراء، وإيضاح موقف الشريعة الإسلاميَّة التي ميَّزت بين الصغار والكبار من حيث المسؤولية الجنائية، واستقت القواعد الوضعية من الشريعة الإسلامية القوانين التي تقوم عليها مسؤولية الصغار في العصر الحاضر، بالرغم من تطورها تطورًا عظيمًا.واعتمدت الدراسة على المنهج التحليلي والمقارن، في طرح ومناقشة مسائلها، وكان من أهم النتائج التي توصَّلَتْ إليها الدراسة: أن العمر أحد معنيَي السن عند الفقهاء، والتمييز يكون ببلوغ سبع سنين؛ لما جاء من الأمر بالصلاة لمن بلغ سبعًا وغيرها من المسائل الفقهية المعتبر فيها السن. |
